Re: Municipal Complex Improvements Building Committee
Dear Mr. Brule:
I write on behalf of the Municipal Complex Building Committee to request that the Board
of Selectman restore to Capital and Non-Recurring Expenditure Fund Line 20530-57695
(Municipal Complex Renovation) the amount of $100,883.00 which was last known to be the
designated but not yet appropriated balance in that line. We have recently discovered this balance
was reclassified by the Town’s former Finance Director as undesignated and then at the end of
fiscal year 2019 moved into line 205-31520 CNR Undesignated Fund Balance at the start of fiscal
year 2020. This reclassification was done without the knowledge of, and without any notice to the
Committee or department staff who serve as liaisons to the Committee.
We offer the following as the basis for our request and as information for others that will
be asked to act on this matter. As you are aware, in the fall of 2019 the Committee discovered that
the Finance Department was assessing legal fees and bonding costs against project funds without
any notice to the Committee. To date the amount deducted totals approximately $46,041.19. The
Committee promptly communicated with the former Finance Director regarding the reductions
and was advised that the costs were properly charged to the project and that there was no
requirement that the Committee either vote on such expenditures or be advised of them. Although
the former Finance Director was present at several of the Committee’s meetings while preparing
to present the project for funding approval to the Board of Selectman/Finance and the RTM, the
Committee was never advised that these costs would be charged to. the project or given any
guidance as to what fees and costs should be included in our funding requests. The Committee
believes that it will likely be assessed additional fees and costs when long term bonding is
finalized.
Being mindful of the total cost of the project, the Committee was conservative in its funding
requests for Contract Administration and Owner Costs above the total Design/Build contract bid
and kept those additional requests as low as responsibly possible. The Committee continues to
work diligently to complete the project within the approved project funding amount. However,
the additional bonding costs and associated fees present a significant burden. Therefore, the
Committee respectfully requests that the funds reclassified as undesignated and subsequently
removed from Capital and Non-Recurring Expenditure Fund Line 20530-57695 (Municipal
Complex Renovation) be restored to address any project shortfall that may occur as a result of
unanticipated bonding costs and associated legal fees.
