Sec. 7-159b — Pre-application review of use of property. Notwithstanding any other provision of the general statutes,
prior to the submission of an application for use of property under chapters 124, 126, 440 and 541 or any other provision
of the general statutes authorizing an authority, commission, department or agency of a municipality to issue a permit or
approval for use of such property, such authority, commission, department or agency or authorized agent thereof may
separately, jointly, or in any combination, conduct a pre-application review of a proposed project with the applicant at
the applicant's request. Such pre-application review and any results or information obtained from it may not be appealed
under any provision of the general statutes, and shall not be binding on the applicant or any authority, commission,
department, agency or other official having jurisdiction to review the proposed project.

Statement of Purpose
Proposed Amendment to Section 6A.6 — Maximum Building Height
VR-7.5, VR-10, and VR-15 Zoning Districts
The purpose of this amendment is to restore the maximum permitted building height in the VR-7.5, VR-10,
and VR-15 
zoning districts from 20 feet to 25 feet in order to ensure fairness, proportionality, and
consistency with current flood-resilient construction requirements, while maintaining the intended low-
density residential character of these districts.
The maximum building height in these districts was reduced from 25 feet to 20 feet on August 1, 2002,
without documented findings or stated rationale supporting the reduction. Since that time, applicable
floodplain regulations and construction standards have evolved significantly, requiring buildings located
in FEMA AE and VE flood zones to be elevated to the Base Flood Elevation pius required freeboard. in
practice, compliance with these requirements necessitates approximately 9 to 10 feet of non-habitable
elevation to accommodate structural systems, utilities, parking, and maintenance access below the
lowest habitable floor.
Under the existing 20-foot height limitation, this mandatory elevation consumes a disproportionate share
of the allowable building envelope, leaving insufficient vertical space for reasonably proportioned
residential construction. As a result, properties that fully comply with flood safety requirements
experience a loss of functional buildability that is unrelated to visual scale, neighborhood character, or
flood risk. This condition is particularly inequitable for lots located at or near higher ground elevations,
which receive no offsetting benefit under the current height measurement approach.
The proposed 25-foot maximum height restores a reasonable balance between required life-safety
elevation and usable habitable space. This adjustment supports typical residential building proportions,
including two-story dwellings with appropriate floor-to-ceiling heights, conventional roof forms, and
compliant vertical circulation, without increasing perceived building mass or altering neighborhood
character.
Importantly, this amendment does not modify or reduce any flood protection, elevation, or coastal
construction requirements. All applicable FEMA, freeboard, and floodplain standards remain fully in
effect. The amendment addresses only the zoning limitation on habitable structure above the required
elevation, aligning the regulation with contemporary construction realities and principles of equitable
land use.
By restoring 
the maximum building height to 25 feet, this amendment corrects an undocumented prior
reduction, improves fairness among properties subject to flood elevation requirements, and promotes
resilient, well-designed residential development consistent with the intent of the VR-7.5, VR-10, and VR-
15 zoning districts.
