The Commission hereby authorizes the applicant to conduct
regulated activities in designated areas which fall under the
jurisdiction of the'Inland Wetlands and Watercourses Act, as
amended, Section 22a-36 to 22a-45, inclusive, of the Connecticut
General Statutes.
This permit is a grant of approval from the Waterford
Conservation Commission to conduct the following requested
regulated activities:
1. 
Filling of 0.06 acres of a manmade pond for the purpose of
constructing a pool and bank stabilization.
2 
Placement of riprap and topsoil along the remaining pond
bank for the purpose of bank stabilization.
All site activities shall be conducted in accordance with the
plans, specifications and documents of record. 
Any deviation
from the approved plans or construction sequence shall be cause
for enforcement action by the Conservation Commission.
The Conservation Commission has reviewed the plans of record and
the file documents and attaches the following conditions in order
to further protect the inland wetlands and groundwater on this
site and to minimize impacts associated with the proposal:
Ls 
A totally enclosed pool filtration system which does not
backwash pool waste water, shall be installed.
2. 
Pool drainage shall not be discharged to any surface waters
or storm drains unless the State of Connecticut, D.E.P.,
Bureau of Water Management, criteria have been met.
3% 
All disturbed areas shall be properly stabilized upon
project completion.
4. 
Any dewatering discharge shall be pretreated to ensure a
clear water discharge prior to entering the Lakes Pond
Brook.

Runoff generated from the construction site shall be
diverted from directly entering Lakes Pond Brook and
the forested wetlands.
The recommendations of the Wetland Ecologist as described on
Page 8 of the report entitled, "Wetland Impact Assessment
Proposed Pond Alterations For Bank Stabilization & Pool
Construction", shall be followed, which includes:
a. 
Introduction of native wetland herbaceous species
along the remaining portion of the pond bank to provide
shoreline stabilization and habitat diversity.
b. 
Establishhent of a 5-10 foot wide natural vegetative
zone of native woody and herbaceous species along the
pond and brook edge to provide for further bank
stabilization and habitat enhancement.
At all.times during site work and until exposed areas are
stabilized, the applicant shall install and maintain erosion
“and sediment control measures such as staked hay bales and
fabric filter fences, and such other measures as deemed
necessary by the Environmental Enforcement Officer. 
Such
protective measures shall be installed and maintained to the
satisfaction of the Environmental Officer.
Erosion control and soil stabilization shall follow
guidelines as established in the Connecticut 
Guidelines for
Soil Erosion and Sediment Control.
The Environmental Enforcement Officer must be notified at
least 48 hours prior to commencement of any permitted site
work.
This permit shall be valid for five years, however once the
regulated activity has been initiated, it shall be completed
within 1 year. 
If the work is not completed within this
time, the permit may be held to be invalid by the
Commission. 
The applicant may be required to petition the
Commission for reissuance of the permit. 
The Commission may
required the applicant to furnish additional information at
that time.
No materials may be deposited and no activities may be
conducted in any regulated areas except for those specified
in this permit in accordance with plans and documents
submitted as part of the application.

The Commission renders this Summary Ruling based on the following
considerations:
A. 
Strict adherence to the conditions imposed with this
permit will protect the quality of surface and ground-
waters on the subject property.
B. 
The value of the resource (pond) to be impacted has
been reviéwed and is considered relatively low.
C. 
The Commission has required additional conditions to
enhance the long term stability and wildlife value of
the pond and brook.
This permit will be strictly enforced. 
The Commission may
suspend or revoke this permit, may direct the Environmental
Enforcement Officer to issue a cease and desist order or may
require the applicant to modify, extend, or revise the site work
or restore the area to its original condition if it finds that
the applicant has not completed with the conditions set forth in
this permit or if the applicant exceeds the scope of this permit
as set forth herein or if the intended use or actual use of the
general site is not as represented by the application or the plan
of record.
