In keeping with Section 3.08.010 of the Purchasing Ordinance- Cooperative Purchasing, the 
Purchasing Department, on behalf the Recreation and Parks department after due diligence 
and careful consideration, is respectfully seeking the Board's approval to Award the 
contract for the Children's Playground Pavilion to M .E . O'Brien & Sons, Inc. 
(MHEC­Cooperative) in the total amount of $96,380.00, pending RTM approval of the

Request for Bid Waiver 
— Playground installation Project
1am writing to formally request a waiver of the standard bidding process for the upcoming playground
installation project at Children’s Playground located in the 
Civic Triangle. This request is made in
accordance with our procurement policies and is based on the following considerations:
1, 
Donor Preference: A partial donor contribution has been pledged toward this project, with a
preference for a specific vendor to ensure continuity and quality of work. Granting this waiver
will honor the donor’s intent while maintaining fiscal responsibility.
2. 
Vendor Qualifications: The recommended vendor, M.E. O'Brien & Sons, is a vetted supplier
under the Massachusetts Higher Education Consortium (MHEC) New England contract. This
cooperative purchasing agreement is designed to help municipalities reduce costs and
streamline procurement through pre-approved vendors.
3. 
Continuity of Service: M.E. O’Brien & Sons performed the original installation of the playground.
Their familiarity with the site and equipment ensures consistency in design, safety standards,
and long-term maintenance compatibility.
4, 
Industry Recommendation: Multiple installers and playground vendors contacted for this
Project have independently referred us to M.E. O’Brien & Sons, citing their expertise and
reliability in similar municipal projects.
Given these factors, we believe that waiving the formal bid process in favor of contracting directly with
M.E. O’Brien & Sons is in the best interest of the town, This approach will expedite the project timeline,
reduce administrative overhead, and ensure high-quality results aligned with community expectations.
We respectfully request your approval of this bid waiver. Please let us know if additional documentation
or information required to proceed.

Suppliers are required 1o market products and services to the MHEC membership directly and
continue to promote sales volume through qualily and superior service.
Upon request, suppliers will supply individual wrillen quotes based on the terms of their
individual contract, i... if pricing is based on a discount off list, the quote will show current list,
contract discount and net price. if based on a markup over dealer net, it will show dealer
cost, contract markup and MHEC Net Price.
Discount pricing may be offered lo a member above and beyond this contract discount
structure in the form of: Special Deals, Sales Catalogs or Bulletins, Promotional Sales, and
Additional Volume Discounts through special quotes for commitled dollar purchases, as long
«a the same pricing will be offered to all current and future member customers who meet the
same ctiteria for the special pricing
Use of the contract is lefl to the discretion of each respective member. No guarantee of
volume has been made to the supplier.
Suppliers will make every effort to identify purchasers contacting them to determine MHEC

details or Prevailing Wage Rates and how they are to be paid on State Jobs and how payroll
