Explanation:
52040 Service Contracts & Repairs requires extra funds needed for background checks/ physicals for new hires and Pond Permits and applications. This will
be covered wilh 52010 Advertising as we have not had as many bid postings for Capital Improvements this year.
§2050 Dues, Conferences and Education provided Ventrac training for 2 employees. This will be covered by Reimbursable Expenses which are not used
throughout the year and reflected in operating budget moving forward.
53010 Office Supplies had an increase in beach stickers and will be covered by 53020 Other Supplies
51810 Overtime increase is due to winter snow removal. This will be covered by Park Maintenance - funds are available duet to an employee leaving for EB

RE: Municipal Host Fee Agreement (Data Center)
Dear Moderator Driscoll:
| am writing to advise you and the members of the Representative Town Meeting that the
Town's Qualified Data Centers Host Municipality Fee Agreement with NE Edge terminated
today. Under the terms of the Agreement attached hereto (see Sections 3 and 12 attached)
a building permit application was required to be filed within thirty-six (36) months of the
signing of the Agreement on March 17, 2023. No such application was filed as of close of
business today. Therefore, according to Town Counsel Nicholas Kepple the Agreement is
no longer in force and effect and neither party has any further duty to the other.
On behalf of the Board of Selectmen, | would appreciate it if you would convey the
Agreement status update to your fellow representatives.

Dear Rich and Greg:
Please be advised that our Town Attorney Nicholas Kepple has notified me that the Qualified
Data Centers Host Municipality Fee Agreement between NE Edge and the Town of Waterford
terminated today. As required by Sections 3 and 12 of the Agreement (see attached) no
building permit application was submitted to the Town within thirty-six (86) months of the
signing of the Agreement on March 17, 2023. Since the Agreement terminated Counsel
informed me it is essentially void and of no effect and neither party owes any duty to the
other as of today.

snowfalis including a blizzard all of which occurred on weekends and non-
union pay increases that weren’t included in the budget when it was approved.

Series Transfer from the Director of Fixe Services, Chris Haley, in the amount
of $9,000 to cover the cost of OSHA required physicals.

7. Wire Services: To consider and act on the following request for a FY26 Out-
of-Series Transfer from the Director of Fire Services, Chris Haley, in the
amount of $9,000 to cover required protective clothing for new firefighters and
forward on to the Board of Finance if approved.

8. Emergency Management Performance Grant: To consider and act upon the
following resolution “resolved, that the Board of Selectmen may enter into
with and deliver to the State of Connecticut Department of Emergency
Services and Public Protection, Division of Emergency Management and
Homeland Security, any and all documents which it deems to be necessary or
appropriate; and further resolved, that Robert Brule, as First Selectman of the

office since November 2019”, for reimbursement of a portion of the

9e. To consider and act on directing the revision of the OnBoard directory

and term schedule specified by ordinance.
