TITLE: Proposed Changes to the Waterford Code of Ordinances Chapter 12.08 Concerning the
possession and drinking of alcoholic beverages in town parks and reoreation areas.
This request fs to consider the potential to allow tho possession ot deluking of alcoholic beverages at
recreational fhoilities during special events approved by the Board of Selectmen. Alcohol is ourrently
prohibited at Towa facilities, This change would enable events sich as concerts, fndiaisers, or festivals
to include the sale and consumption of beer or wine, The change wotld.not enable possession of alcohol -
at school proporties or ot beashes.
Changing this Ordinance is a key step In teduelng restrictions on the range of events that cat be held on
town properties. The addition of cavefully planned service of wits or beer can help broaden patticipation
in Waterford events and drasy row altraotlons to Town. Enabling sanctioned alcohol cousumption Ja
public places supports ongoing offorts increase the frequonoy and diversity of dynamic and vibrant events
in Waterford, Events fike dimers at the historic Jordan Green, summer concerts at tho Waterford Beach
Park, or craft beer and wine tasting at the Famors Market could be permitted if the Ordinance is changed. ’
As proposed, the change would only atlow beer and wine to bo available as sanctioned on a case-by-case
basis by the Board of Selectinon,

area; including Waterford Beach, is prohibited except as provided below:

Hold-Harmless and Indemnification
Agreement
The Applicant shall fully indemnify, defend and hold harmless the Town of Waterford and/or
the Waterford Board of Education and all of their respective officers, employees, agents,
servants and volunteers to the fullest extent allowed by law for any claim for personal injury,
bodily injury, death, property damage, emotional injury or any other injury, loss or damage of
any kind occurring during the term of the agreement and alleged to have been caused in whole
or in part by the Applicant, and even if caused by the negligence of the Town and/or the Board
of Education or any of their officers, employees, agents, servants and volunteers. This
obligation shail further apply to:

actions, suits, claims, demands, investigations and legal, administrative or arbitration
proceedings pending or threatened, whether mature, unmatured, contingent, known or
unknown, at law or in equity, in any forum (collectively, “Claims”) arising, directly or
indirectly, in connection with this contract, including any environmental matters, and
including the acts of commission or omission (collectively, the “Acts”) of the Applicant or
any of its members, directors, officers, shareholders, representatives, agents, servants,
consultants, employees or any other person or entity with whom the applicant is in
privity of oral or written contract (collectively “Applicant Parties”);
liabilities arising, directly or indirectly, in whole or in part, in connection with this
contract, out of the Applicant’s or Applicant Parties’ Acts concerning its or their duties
and obligations as set forth in this contract, and;
all damages, losses, costs and expenses, including but not limited to, attorneys’ and
other professional fees, that may arise out of such claims and/or liabilities for personal
injury, bodily injury, workers’ compensation, emotional injury, death, property damage
or any other injury or loss caused in whole or in part by the Acts of the Applicant or any
Applicant’s Parties. The Applicant hereby covenants and agrees that the Town and/or
the Board of Education shall be endorsed on the Applicant’s policies of insurance as
additional insured. The Applicant hereby further covenants and agrees to obtain a policy
of insurance, with minimum limits of liability as shown in this Section under Paragraph A
containing an endorsement that covers this agreement to indemnify, defend and hold

harmless the Town and/or Board of Education or any of their officers, employees,
agents, servants and volunteers. The Applicant hereby further covenants and agrees to
obtain an endorsement to said policy of insurance policy that the Applicant’s insurance
is primary and any insurance obtained, or self insurance provided, by the Town and/or
Board of Education is excess. The Applicant’s insurance carrier will waive all rights of
subrogation against the Town and/or Board of Education, and all of their respective
officers, employees, agents, servants and volunteers. The Applicant hereby further
covenants and agrees to furnish a copy of the insurance policy that meets all of the
above requirements before any work or use of the property commences.

As your aware, the Commission’s request to increase Town Beach parking fees was tabled at the RTM
meeting of February 3, 2020. The reason for the incfease was due to the State of Connecticut legislature
repealing the sales tax exclusion for municipal seasonal parking ots.
At our commission meeting held on February 25, 2020, the commission decided to keep the original
request (Minutes attached),

The Recreation and Parks Commission held their regular meeting on Tuesday, February 25, 2020 at the
Community Center. Chairman Santos presided.

MOTION #1: Made by C. Erticson, seconded by C. Whelan to approve the minutes of the January 28,
2020 meeting as received, So voted 7-0.

STAFF REPORTS: The Director reported on the expenditures ($852,913 — 56%) and revenues at
$165,754 - +1.3% from 2019). He discussed the major emphasis on the Civic Triangle trall/areas and
improvements around the pond areas. The Board of Selectmen approved our revised Fiscal Year 20-21
budget for $1,519,608 (0% Increase). The Board of Finance will hear our budget on March 4, 2020 @
7:00 p.m. A discussion was held on the Credit card/software update with a plan to move forward. We
have had a Mitchell College student intern, Hanna Corrigan, spending a few months with the
department, The RTM, at their February 3, 2020 meeting tabled our request to increase Waterford
Beach parking fees (originally brought forward when we were advised the state is requiring sales tax to
be charged) in order for us to provide additional information for their April 6, 2020 meeting. Our
proposed current year 2021 CIP projects (Tennis Court Replacements, Vet's Field Lights and Vet's Garage
Addition plan) have been moved forward in the plan by the Board of Selectman. The Waterford Beach
Bathroomis (2) are still in the planning stages, as the plans for the pre-cast building cannot be used,
according to Ct. DEEP, as they would have to meet VE zone standards. The Board of Selectman
recommended $150,000 in CNR funds for the bathrooms/improvements. Tennis Court repairs need to
be completed this spring. The Leary Park Basketball court reconstruction and the Town Hall basketball
court repairs are planned for the spring of 2020. The Dog Park Fence replacement is near completion.
MOTION #2: Made by C. Erricson, seconded by C. Hall to keep the same recommendation as approved
by the Commission, to request an increase in beach fees due to the sales tax as directed by the State of
Ct. A discussion was held. Motion carried 7-0.
MOTION #3: Made by C, Erricson, seconded by C. Gardiner to request an additional $9,000 ta complete
the temporary repairs to the tennis courts. So voted 7-0,

Waterford Beach Park
The Waterford Recreation and Parks Department in Waterford, Connecticut has attached Marker Permit
Application to this cover fetter. We currently have on file applications for marker permits; however, they
needed to be updated. The Town of Waterford has purchased a parcel of land that connects with a State of
Connecticut small parcel of beachfront. Therefore we are asking to extend the restricted swim area buoys
by two (2) making our total number of buoys eight (8) at the Waterford Beach Park. Also attached is the
Marker Permit Application for the Pleasure Beach which is much smaller and connects with Perry
Development Beach and the Association Beach.
Below is a listing of the types of buoys and their distances in the waters.
WATERFORD BEACH PARK ~ 317 GREAT NECK ROAD, WATERFORD, CT 06385

Eight (8) restricted swim area buoys (three dimensional markers) installed as specified on
attached map.
Each buoy shall be regulatory buoy with minimum dimensions of at least 9” in diameter and 61”
in height.
Each buoy shall be constructed of Acrylonitrile-Butadien-Styrene (ABS) or equivalent filled with
polyurethane foam or equivalent and shall have sufficient ballast to maintain proper stability
and exposure.
Each buoy shall be white with a minimum 3’ (silver) reflective band at the top together with
boats excluded symbol on two sides, with orange band on top and bottom stating “SWIM AREA”
in black lettering.
The eastern corner regulatory buoy will be placed approximately 220’ offshore on a line running
approximately perpendicular to the shoreline just west of the large rocks offshore. They will be
heading westerly direction parallel with the water’s edge the next buoy will be approximately
150’ from the first and continue to the last buoy which will be approximately 200’ from the rock
structure separating Waterford Beach and Camp Harkness and centered with the end of our
swim area. This Buoy will read No Boats Allawed or can be modified at the discretion of the
D.E.E.P.
Two (2) lines of barrier floats will be placed at either end of the swim area going from the
waterfront to the corner buoy at approximately 220’ each.
We will follow any and all other regulations as deemed by the State of Connecticut DEEP.
