Proposals for the above mentioned project were opened on August 10, 2023 by Jim
Bartelli, Director of Utility Commission and I with the attached results. After careful
review of proposals, it ts determined that Holzner Construction Company is the lowest
qualified bidder able to complete this project.
I therefore respectfully seek the Board’s approval to award the contract to Holzner
Construction Company for $2,113,850.00.
Funds will be available in line# 20531-57816 Old Norwich Road Pump Station.

Subject: Recommendation for Award for the “Town of Waterford, CT Old Norwich Road Sewer Pump
Station Upgrades”
Dear Mr. Bartelli:
We have completed our review of the construction bids that were received for the subject project on August 10,
2023. Based on our evaluation, we are not aware of any reason why this contract should not be awarded to Holzner
Construction Company as the lowest responsive bidder. We therefore recommend that the Town consider awarding
the contract to Holzner Construction for $2,113,850.
Five bids were received and reviewed. A tabulation of the bids is enclosed. Bids received were in the range of
$2,113,850 to $3,129,000,
We performed reference checks on Holzner Construction. References came back positive for their previous work
on similar projects.
Wright-Pierce has worked with Holzner Construction on some similar past projects with satisfactory
results. These include a $1.8M project for pump station upgrades for the Town of Hebron completed in
2023 and various upgrades at the Stafford Springs WPCF. Holzner’s list of past and present projects
includes several other projects that are similar in nature to the Old Norwich Road pump station upgrades.
Reference checks came back positive for their work on a comprehensive upgrade at the Curcombe Street
(Hartford) Pump Station and work with the Stamford WPCA.
Wright-Pierce was able confirm Holzner’s good financial standing with their financial institution.
Additionally, Holzner appears to have sufficient bonding capacity to complete the referenced project.

Gentlemen:
The undersigned hereby declares that no person or persons other than those named
herein are interested in this proposal or in the Contract proposed to be taken; that it is
made without any connection with any other person making any proposal for the same
work, and is in all respects fair and without collusion or fraud; that no person acting for
or employed by the Town of Waterford is directly interested therein, or in the supplies or
works to which it relates, or in any portion of the profits thereof; that it is understood that
the Town, its agents and employees are not to be in any manner held responsible for
the accuracy of, or bound by, the estimates or borings or plan of borings relative to the
work and appearing on plans or in the foregoing notice; and that all such estimates,
eic., are to be considered solely for the purpose of filling out and comparing the several
proposals.
The undersigned further declares that he has carefully examined the Information For
Bidders, Contract documents, including the Plans and Specifications, and has
inspected the site and will contract to provide all necessary tools, apparatus and
implements, freight, cartage, and expense, and to do all the work and furnish all the
materials necessary in the manner and upon the conditions specified and upon the
following terms at the prices specified on the following pages.
The undersigned agrees to furnish satisfactory bonds and insurance as required by the
General Conditions, the Information for Bidders and by the Supplementary Conditions,
and to execute within 30 days after notice of the award, a formal contract with the Town
of Waterford for the fulfillment of this proposal, and itis agreed that in case of failure on
the part of the undersigned to do so, the certified check or bid bond deposited herewith
shall be forfeited to the Town of Waterford as liquidated damages for such failure.

BIDDER hereby agrees to commence work under this contract on or before a date to
be specified in written NOTICE TO PROCEED of the OWNER and to fully complete the
project in strict compliance with the Contract Documents within 120 consecutive
calendar days thereafter as stipulated in the specifications. BIDDER further agrees to
pay as liquidated damages, the sum of $1,000 for each consecutive calendar day
thereafter as hereinafter provided in Paragraph 15 of the Information for Bidders.

Bidders

COMMISSION ON HUMAN RIGHTS AND OPPORTUNITIES
CONTRACT COMPLIANCE REGULATIONS
NOTIFICATION TO BIDDERS
(Revised 09/3/15)
The contract to be awarded is subject to contract compliance requirements mandated by Sections 4a-60 and 4a-
60a of the Connecticut General Statutes; and, when the awarding agency is the State, Sections 46a-71(d) and
46a-8 li(d) of the Connecticut General Statutes. There are Contract Compliance Regulations codified at Section
46a-68j-21 through 43 of the Regulations of Connecticut State Agencies, which establish a procedure for
awarding all contracts covered by Sections 4a-60 and 46a-7 I (d) of the Connecticut General Statutes.
According to Section 46a-68}-30(9) of the Contract Compliance Regulations, every agency awarding a contract
subject to the contract compliance requirements has an obligation to “aggressively solicit the participation of
legitimate minority business enterprises as bidders, contractors, subcontractors and suppliers of materials.”
“Minority business enterprise” is defined in Section 4a-60 of the Connecticut General Statutes as a business
wherein fifty-one percent or more of the capital stock, or assets belong to a person or persons: “(1) Who are active
in daily affairs of the enterprise; (2) who have the power to direct the management and policies of the enterprise;
and (3) who are members of a minority, as such term is defined in subsection (a) of Section 32-9n.” “Minority”
groups are defined in Section 32-9n of the Connecticut General Statutes as “(1) Black Americans. . .
(2) Hispanic Americans . . . (3) persons who have origins in the Iberian Peninsula... (4) Women... . (5) Asian
Pacific Americans and Pacific Islanders; (6) American Indians . ..” An individual with a disability is also a minority
business enterprise as provided by Section 4a-60g of the Connecticut General Statutes. The above definitions apply
to the contract compliance requirements by virtue of Section 46a-68j-21(11) of the Contract Compliance
Regulations.
The awarding agency will consider the following factors when reviewing the bidder's qualifications under the
contract compliance requirements:
(a) the bidder's success in implementing an affirmative action plan;
(b) the bidder's success in developing an apprenticeship program complying with Sections 46a-68-1 to
46a-68-17 of the Administrative Regulations of Connecticut State Agencies, inclusive;
(c) the bidder’s promise to develop and implement a successful affirmative action plan;
(d) the bidder’s submission of employment statistics contained in the “Employment Information
Form”, indicating that the composition of its workforce is at or near parity when compared to the
racial and sexual composition of the workforce in the relevant labor market area; and
{e) the bidder's promise to set aside a portion of the contract for legitimate minority
business enterprises. See Section 46a-68)-30(10) (E) of the Contract Compliance Regulations.
INSTRUCTIONS AND OTHER INFORMATION
The following BIDDER CONTRACT COMPLIANCE MONITORING REPORT must be completed in full, signed, and submitted
with the bid for this contract. The contract awarding agency and the Commission on Human Rights and Opportunities will use the
information contained thereon to determine the bidder’s compliance to Sections 4a-60 and 4a-60a CONN. GEN. STAT., and
Sections 46a-68j-23 of the Regulations of Connecticut State Agencies regarding equal employment opportunity, and the bidder's
good faith efforts to inclide minority business enterprises as subcontractors and suppliers for the work of the contract.
1) Definition of Small Contractor
Section 4a-60g CONN. GEN. STAT. defines a small contractor as a company that has been doing business under the same
management and control and has maintained its principal place of business in Connecticut for a one year period immediately prior
to its application for certification under this section, had gross revenues not exceeding fifteen million dollars in the most
recently completed fiscal year, and at least fifly-one percent of the ownership of which is held by a person or persons who are
active in the daily affairs of the company, and have the power to direct the management and policies of the company, except that a
nonprofit corporation shall be construed to be a smal! contractor if such nonprofit corporation meets the requirementsof
subparagraphs (A) and (B) of subdivision 4a-60g CONN. GEN. STAT,

Non-Discrimination and Affirmative Action Provisions
(A)C) The Contractor agrees and warrants that inthe performance of the Contract such Contractor
will not discriminate or permit discrimination against any person or group of persons on the
grounds of race, color, religious creed, age, marital status, national origin, ancestry, sex, gender
identity or expression, sexual! orientation, intellectual disability, mental disability or physical
disability, including, but not limited to, blindness, unless itis shawn by such Contractor that such
disability prevents performance of the work involved, in any manner prohibited by the laws of the
United States or of the state of Connecticut, The Contractor further agrees to take affirmative action
to insure that applicants with job-related qualifications are employed and that employees are treated
when employed without regard to of race, color, religious creed, age, marital status, national origin,
ancestry, sex, gender identity or expression, intellectual disability, mental disability or physical
disabilily, including, but not fimited to, blindness, unless it is shown by such Contractor that such
disability prevents performance of the work involved; (2) the Contractor agrees, in ali solicitations
or advertisements for employees placed by or on behalf of the Contractor, to state that it is an

(B)Any Contractor who is a party toa municipal public works contract or quasi-public agency project,
where any such contract is valued al less than $50,000 for each year of the contract, shall provide
the Commission on Human Rights and Opportunities with a written or electronic representation thal
complies with the sondiscrimination agreement and warranty under subsection {A)() above,
provided if there is any change in such representation, the Contractor shall provide the updated
representation to the Commission not later than 30 days after such change. Any Contractor who is
a party to a municipal public works contract or a quasi-public agency project, where any such
contract is valued at $50,000 or more for any year of the contract, shall providethe Commission
with any one of the following: (L} Documentation in the form of a company or corporate police
adopted by resolution of the board of directors, shareholder, managers, members or other gIoveming
body of such Contractor that complies with the nondiscrimination agreement and warranty under
subsection (A)(1) of this section; (2) Documentation in the form of a companyor corporate policy
adopted by a prior resolution of the board of directors, shareholders, managers,members or other
governing body of such contractor if (a) the prior resolution is certified by aduly authorized
corporate officer of such contractor to be in effect on the date the documentation is submitted, and
the executive director of the Commission on Human Rights and Opportunities ordesignee certifies
that the prior resolution complies with the nondiscrimination agreement and warranty under
subdivision (A)(1) of this section; or (3) Documentation in the form of an affidavitsigned under
penalty of faise statement by a chief executive officer, president, chairperson or othercorporate
officer duly authorized to adopt company or corporate policy that certifies that the company or
corporate policy of the contractor complies with the nondiscrimination agreement and warranty
under subdivision (A}(1) of this section and is in effect on the date the affidavit issigned.

(C) [Fthe Contract is a municipal public works contract or a quasi-public ageney project, the
Conwactor agrees and warrants that s/he will make good faith efforts to employ minority business
enterprises as subcontractors and suppliers of materials on such public works project. The
Contractor shall include the provisions of subdivision (A)(1) of this section in every subcontract
or purchase order entered into to fulfill any obligation of a municipal public works contract or
contract for a quasi-public agency project, and such provisions shall be binding on a subcontractor,
vendor or manufacturer, unless exempted by regulations or orders of the Commission on Human
Rights and Opportunities, The Contractor shall take such action with respect to any such
subcontract or purchase order as the Commission may direct as a means of enforcing such
provisions, including sanctions for noncompliance in accordance with section 46a-56; provided, if
such Contractor becomes involved in, or is threatened with, litigation with a subcontractor or
vendor as a result of such direction by the Commission regarding a statecontract, the contractor
may request the state of Connecticut to enter into any such litigation or negotiation prior thereto to
protect the interests of the state and the state may so enter.
{D) "Minority business enterprise" means any smal! contyactor or supplier of materials fifty-one per
cent or more of the capital stock, if any, or assets of which is owned by a person or persons: (1)
Who are active in (he daily affairs of the enterprise, (2) who have the power to direct the
management and policies of the enterprise and (3) who are members of a minority, as such term is
defined in subsection (a) of section 32-9; and "good faith" means that degree of diligence which
a reasonable person would exercise in the performance of legal duties and obligations. "Good faith
efforts" shail include, but not be limited to, those reasonable initial efforts necessary to comply
with statutory or regulatory requirements and additional or substituted efforts when it isdetermined
that such initial efforts will not be sufficient to comply with such requirements. Determination of
the Contractor's good faith efforts shal] include, but shall not be eliminated to, the following factors:
The contractor's employment and subcontracting policies, patterns and practices; affirmative
advertising recruitment and training; technical assistance activities and such other reasonable
activities or efforts as the Commission on Human Rights and Opportunities may prescribe that are
designed to ensure the participation of minority business enterprises in municipal public works
contracts or quasi-public agency projects. “Municipal public works project” means that portion of
an agreement entered into on or after October 1, 2015, between anyindividual, form or corporation
and a municipality for the construction, rehabilitation, conversion, extension, demolition or repair
of a public building, highway or other changes or improvements inreal property, which is financed
in whole or in part by the state, including, but not limited te, matching expenditures, grants, foans,
insurance or guarantees but excluding any project of an alliance district, as defined in section 10-
262u, finance by the state funding in an amount equal to fifty thousand dollars or less. “Quasi-
public agency project” means the construction, rehabilitation, conversion, extension, demolition or

into on or after October 1, 2015, which is financed in whole or in part by a quasi-public agency
