Unauthorized Fill Within Inland Wetlands
Mr. Lenart:
This letter is a notification that you have conducted activity within inland wetland and watercourse areas
in violation of Waterford Conservation Commission permit #09-06 and Section 6 of the Waterford Inland
Wetlands & Watercourses Regulations. The placement of a stone pad and stone pavers within wetlands
located on your property at 577 Vauxhall Street Extension and in wetland on the adjacent City of New
London property bordering Lake Brandegee is not authorized.
At their meeting held on June 8, 2023, the Waterford Conservation Commission heard your proposal to
modify Permit #09-06 to construct and maintain a stone patio in wetlands on your property and remove
the portion of the patio constructed on wetlands located on the City property. The Commission did not
approve the restoration plan and proposed permit modification and required removal of the unauthorized
patio from wetlands.
The following Corrective Actions are required to correct the unauthorized fill activity:
1. Remove the stone pad and stone pavers from the wetland area on 577 Vauxhall Street
Extension and the adjacent City of New London wetlands to the surface of the wetland
substrate. A 4 ft. wide stone border is authorized to remain along the edge of shoreline on
your property at 557 Vauxhall Street Extension for shoreline stabilization purposes. The
stone-lined 25 ft. length walkway permitted under Inland Wetland Permit #09-06 can be
maintained and lined with paver stone.
2. Removal of the unauthorized wetland fill shall be completed no later than November 1, 2023.
Upon completion of the restoration work, contact the Waterford Planning & Development
office to schedule a site inspection for compliance with the corrective actions.

This notice is issued in accordance with Section 14 of the Town of Waterford Inland Wetlands and
Watercourses Regulations. Failure to comply with the terms of this letter may result in further
enforcement action by the Waterford Conservation Commission, including but not limited to the issuance
of a cease and desist order or referral to Town counsel for legal action.
