FIFTEEN ROPE FERRY ROAD WATERFORD, CT 06385-2886 Notice of Violation Waterford Inland Wetlands & Watercourses Regulations 1122, 1124 Hartford Turnpike Date: May 26, 2022 To: Joao Ferreira, Owner East Lyme Tree Services, LLC 67 Upper Pattagansett Road East Lyme, CT 06333 Re: Unauthorized fill, grading and deposition of materials adjacent to inland wetlands 1122, 1124 Hartford Turnpike Mr. Ferreira, On May 25, 2022, a site inspection of your property located at 1122 and 1124 Hartford Turnpike, Waterford, CT was conducted by this office. Based on the site inspection, the following activities were observed to have been conducted without authorized permits: 1. Deposition of earthen fill and asphalt millings west and south of the barn outbuilding extending to the edge of a delineated wetland area (pink survey ribbons evident on branches from previous delineation) located behind the outbuilding; 2. Clearing of vegetation and grading of approximately 200+ linear feet of a hillslope within the 100 ft. upland review area of on-site inland wetlands, resulting in exposed soil and deposition of sediment immediately adjacent to inland wetlands; 3. Deposition of wood chip fill upslope and adjacent to delineated inland wetlands (blue survey flags evident on branches) on the north side of the property. The activities described above were conducted within the 100 ft. upland review area of inland wetlands without required authorization pursuant to Section 6 of the Waterford Inland Wetlands and Watercourses regulations and constitute a violation of these regulations. To address the above noted non-compliance issues, the following corrective actions are required at this time. Required Corrective Actions: 1. Within 14 days of receipt of this notice, remove deposited fill material from the immediate boundary of the wetland behind the barn outbuilding and install a wood chip berm or hay bale barrier between the exposed fill material and the stone wall at the wetland boundary to prevent erosion of sediments into the wetland resource. Stabilize eroding slopes by seeding and install erosion and sediment controls measures on the site to control erosion of exposed soils. 3. Contact this office to schedule a review of the erosion and sediment control measures implemented. 4, Within 45 days of receipt of this notice, submit a site stabilization and buffer restoration plan, prepared by a licensed engineer, to this office for review and approval by the Waterford Conservation Commission. The site stabilization and buffer restoration plan shall at a minimum include; the extent of clearing, fill, and wood chip deposition on the property in relation to the on- site inland wetland resource boundaries; = removal of fill materials and stabilization of exposed soils within 50 feet of inland wetland boundaries; = restoration of vegetated wetland buffer areas adjacent to inland wetlands, including a planting plan and timetable for completing the restoration; and = proposed erosion and sediment control measures to stabilize the site against soil erosion and sedimentation impacts. The Waterford Conservation Commission will review the proposed buffer restoration plan and may require additional measures to remediate this violation. This Notice of Violation has been issued in accordance with Section 14 of the Town of Waterford Inland Wetlands and Watercourses Regulations. Failure to comply with the terms of this notice may result in further enforcement actions by the Town of Waterford.
