Two-Lot Resubdivision with Regulated Activities
NARRATIVE:
Above-referenced application is for approval of requlated activities relative to a
two-lot resubdivision and for a favorable report to the Waterford Planning &
Zoning Commission for the resubdivision. The Application is a re-submittal of a
previous resubdivision application approved with conditions by the
Conservation Commission under Permit #07-25 on September 27, 2007, which
approval is now expired. A copy of the application is attached hereto.
The 2007 approved plan proposed work in the wetlands in the area of the
existing Josan Drive cul-de-sac. The current application proposes work only in
the regulated upland review area as shown on a plan entitled “Brown
Resubdivision, Existing Conditions/Lot Layout & Details/Typicals & Additional
Mapping, Sheets 1-3, Prepared for Sharon C., Brown, 9 Josan Drive, Waterford,
CT, prepared by Brian D. Florek, LS, Dated July 17, 2023."
Activities inciude construction of a shared driveway, including grading &
construction of a stone swale along the eastern edge of the shared portion of
the drive and installation of underground utilities for two new single-family
residences.
A seport prepared by R. Richard Snarski, Professional Wetlands Scientist #1391,
Registered Professional Soil Scientist, Consulting Botanist, New England
Environmentat Services, dated February 14, 2023, states, “On February 10, 2023, |
reviewed the wetiand boundary in the field, which | previously delineated in
2007 at 9 Josan Drive, Waterford, CT“ and “The wetland and watercourse
boundary has not changed."
In his report dated 9/12/2007, when the proposal was to fill the 616SF wetlands in
the area of the cul-de-sac, Snarski stated "I believe mitigation for filling the
isolated wetlands is not needed, because the wetland is very low quaiity and is
not providing any of the typical wetiands functions." Said wetland Is no longer
proposed fo be filled.

‘The Conservation Commission hereby authorizes the applicant to conduct regulated activities in
designated areas that fall under the jurisdiction of the Inland Wetlands and Watercourses Act, as
amended, Section 22a-36 to 22-45, inclusive, of the Connecticut General Statutes,
‘This permit is a grant of approval from the Waterford Conservation Commission to conduct the following
regulated activities:
1. Fill of 0.01 acre of inland wetland for construction of a shared residential driveway.
2. Excavation and grading on slopes adjacent to inland wetlands for construction of a shared
residential driveway.
These regulated activilies are associated with the proposed re-subdivision of a 4.577 acre property located
at 9 Josan Drive, Waterford, Connecticut. The proposed activity is shown on site plans entitled;
“BROWN RE-SUBDIVISION, LOT LAY-OUT/TOPOGRAPHIC PLAN and BOUNDARY SURVEY
and EROSION & SEDIMENT CONTROL PLAN, PROPERTY BELONGING TO SHARON C,
BROWN, 9 JOSAN DRIVE, WATERFORD, CONNECTICUT” prepared by W. F. Kent, RLS,, dated
July 18, 2007, Revised: September 14, 2007, sheets | and 2.
The Conservation Commission has reviewed the application materials and site plan and attaches the
following conditions to minimize impacts associated with the proposed regulated activities and further
protect the inland wetlands and watercourses on this site:
SPECIAL CONDITIONS:
|. Construction of the shared driveway portion, rip-rap drainage swale, catch basin inlet and
drainage extension shall be completed prior to the start of residential lot construction.
2. The temporary sediment trap and diversion swale shall be installed at the initiation of driveway
construction to control run-off and sediment transport from the disturbed slopes.
3. Upon completion of grading for the driveway, all exposed soils shall be treated with a layer of
topsoil, seeded, mulehed and where slopes exceed 3;] — protected with erosion control blanket to
promote re-establishment of vegetation and soil stabilization.
4. A wetland non-encroachment area designation shall be placed over the Open Space to minimize
disturbance to vegetation and soil stability of land adjacent to inland wetlands and protect
adjacent inland wetlands from direct and indirect impacts associated with construction and
residential use of the site. No activity; including clearing, grading, excavation, fill or removal of
vegetation shall be conducted within the wetland non-encroachment area without specific permit
authorization from the Conservation Commission.

5. The wetland non-encroachment boundary between Lot 2 and the Open Space shall be defined
from the northeast corner of the Open Space land abutting Lot 2, extending south-southeasterly to
a point 90 ft, upslope of wetland flag #6, and then extending southeast to the southwestern
property corner of Lot 2,
6. The wetland non-encroachment lines and authorized limits of clearing shall be marked on the site
by a licensed surveyor and reviewed by the Commission’s agent prior to the start of site
construction activities.
7. The designated wetland non-encroachment limit shall be marked on the property with permanent
markers provided by the Conservation Commission to clearly identify the boundary of the non-
encroachment area. The markers shall be affixed to trees along the non-encroachment limit.
Where existing vegetation is not sufficient to locate markers, placement of boulders or plantings
along the non-encroachment line shall be coordinated with the Commission’s agent to provide
permanent demarcation of this limit.
8. Site plans for lot development shall be reviewed by the Commission’s agent for grading, erosion
and sediment controls, and slope protection measures prior to issuance of a building permit for
Lot 1 or lot 2.
STANDARD CONDITIONS:
9. The Conservation Commission’s agent shall be notified at least 48 hours prior to commencement
of any regulated activity.
10. Final stabilization of disturbed soil areas shall be stabilized with the application of loam, seed,
required plantings and appropriate erosion control measures.
11. Atall times during site work and until soil areas are stabilized, the applicant shall install and
maintain erosion and sediment control measures such as fabric filter fence, staked hay bales or
other measures deemed necessary by the Commission’s agent to prevent erosion and
sedimentation impacts to wetlands and watercourses.
12. Erosion control and soil stabilization measures shall comply with the approved plans and the
guidelines as established in the Connecticut Guidelines for Soil Erosion and Sediment Control,
2002, CTDEP Bulletin 34.
13, Upon direction of the Commission’s agent, erosion and sediment control measures shall be
removed by the applicant following stabilization of the site.
All work and all regulated activities conducted pursuant to this authorization shall be consistent with the
terms and conditions of this permit. Any structures, excavation, fill, obstructions, encroachments or
regulated activities not specifically identified and authorized herein shall constitute a violation of this
permit and may result in permit modification, suspension or revocation,
In the event that any additional wetland or watercourse regulated activities are required as a result of other
agency permitting to support the proposed facility, the Waterford Conservation Commission reserves the
tight to reconsider development of this site and may require design modifications to minimize the impact
to regulated resources.

In evaluating this application, the Commission has relied on information provided by the applicant. If
such information subsequently proves to be false, incomplete and/or inaccurate, this permit shall be
modified, suspended or revoked.
This permit shall be valid for a period of 5 years, If the regulated activity is not completed within this
time frame, the permit may be held to be invalid by the Conservation Commission and the applicant may
be required to petition the Commission for an extension or re-issuance of the permit. The Commission
may require the applicant to furnish additional information at that time.
The Conservation Commission renders this Summary Ruling in accordance with the Waterford Inland
Wetlands and Watercourses Regulations based on the following considerations:
A. The wetland area affected is an isolated area of groundwater discharge and does not provide
wetland functions, Fill of this area does not involve significant impact to wetland resources.
B. Alternative access locations from Josan Drive to the proposed residential development that avoid
or reduce wetland impact are not feasible due to the location of the wetland at the property
frontage and the surrounding steep slopes.
C. A designated wetland non-encroachment area is identified to protect adjacent wetlands from
clearing, disturbance and potential soil erosion, minimizing potential wetland impacts from future
use and development of the property.
D. Short-term construction impacts to adjacent wetlands will be controlled by installation and
maintenance of erosion and sediment controls and specified construction run-off controls.
This permit will be strictly enforced. If the Conservation Commission finds that the applicant has not
complied with the permit conditions or has exceeded the scope of this permit as set forth herein, or, if the
intended use of the general site is not as represented by the application or the plan of record, the
Commission may suspend or revoke this permit, direct the Environmental Officer to issue a cease and
desist order, require the applicant to modify, extend or revise the site work, or require the applicant to
restore the area to its original condition.

Ae you requested, I evaluated two wetland areas at 9 Josan Drive in Waterford. The field evaluation was
oondueted on August 7, 2007 and September 11, 2007,
‘The first wetland is loonted at the end of Joan Drive, This is marked with flags 33-37, The wetland is
approximately 25° x 25" in size, EG te melas gies eens |» The eastern half of the
wotland 1s wooded, Sapling size Red Maple and Black Birch trees occupy the canopy, Other speoies in
the wetland include Highbush Blueberry, Multiflora R be aia pe Goldenrod. The soi! type in
the wetland ig eg ea Ridgebury ie drained soil in glacial till. Surface water may
occur at the surface during wet periods. surface water may sheet flow onto the road, The wetland
does not pond water, The wetland is 616 square feet in size and is not contiguous to other wetlands, The
wetland may be the tip of a larger wetland which was filled for the construction of Josan Drive oul-de-
sac. The wetland is low quality. The wetland dogs not provide habitat for wetland dependent
species. Approximately 250 square feet of he wetland is mowed lawn, The wetland does not provide
any significant flood srorage capacity, pollutant renovation capaoity or groundwater recharge oapsdity,
The second wetland area occurs on the south central portion of the property, The majority of the wetland
is wooded, The northem section does not have trees or shrubs, the wetland ex! into tho adjoining
roperty to the north, which is a lawn wetlend. The dominant tree species are Red Maple and Hickory,
fapanege Barberry is the dominant shrub species in the wetland. Other plant species include Arrowwood,
ighbush Blueberry, Tussock — Greenbriar, Asiatic Bittersweet, Cinnamon Fern, Skunk Cabbage,
Virginia Creeper, Spicebush, Sedge, Arrow-leaved Tearthumb, Wineberry, Goldenrod, Jewelweed,
Umbrella Sedge, ¢ Sedge and Tussock Sedge.
During wet periods, surface water exits the wetland in sheet flow between wetland flags 1 and 15, The
wetland has good plant diversity for a small size wetland, The wetland: extends northerly onto the

flags 1 and 15. wetland soil does not pond water in sufficient depth to support amphibian mead

wildlife habitat mainly due to its relatively small aize. The wetland has a moderate value for pollutant
renovation, groundwater discharge and a low-value for flood storage duc to the small size of the wetland.
The proposal is (o construct two house lots and fill the 616 square foot wetland at the end of Josan Drive
for tae construction of a driveway, I believe mitigation for filling the isolated wetland is not needed,
because the wetland is very low quality and is not providing any of the typical wetland functions,
