FIFTEEN ROPE FERRY ROAD WATERFORD, CT 06385-2886 PHONE: 860-442-0553 www.waterfordct.org NOTICE OF NON-COMPLIANCE February 5, 2024 Inland Wetlands & Watercourses Regulations 9 Waterview Drive, Waterford, CT To: Clairmont Management, LLC c/o Amanda Plateroti 9 Waterview Drive, Waterford, CT 06385 Re: Unauthorized Deposition of Materials In & Adjacent to Waterbodies 9 Waterview Drive, Waterford Ms. Plateroti, On February 1, 2024, my office conducted a site visit at property located 9 Waterview Drive at the request of your contractor and Waterford Dept. of Public Works to assess an erosion issue occurring along the north side of the property and discharge of eroded materials into the pond, It was observed that a drainage trench installed along the northern side of the residence has eroded and the backfill materials were deposited in the downgradient pond. The deposition of material into the pond is in violation of the Waterford Inland Wetlands & Watercourses regulations. By this letter, you are requested to: 1. Remove any obstructions within the 18 inch drainage pipe installed along the north side of the property to promote flow. 2. Install hay bales or stone check dams within the eroded trench on the north side of the residence to prevent additional erosion and deposition of materials into the downslope channel and/or pond. 3. Contact the Waterford Planning & Development office within 7 days of your receipt of this notice to discuss temporary and permanent soil stabilization measures and timely removal of eroded materials from the pond and adjoining lawn area. 4. Within 14 days of receipt of this notice, submit a soil stabilization and materials removal plan identifying measures to stabilize the eroded trench and the existing channel outlet against further erosion, and to remove the accumulated materials from the pond edge. The plan must include the anticipated timing of the stabilization measures, timing for removal of deposited material from the edge of the pond and temporaty erosion and sediment controls to prevent additional deposition of material into the water, Please submit the restoration plan to the Environmental Planner. The plan will be reviewed with the Waterford Conservation Commission for approval of activity in and adjacent to the waterbody. Within 30 days of approval of the restoration plan, remove accumulated materials from the waterbody and edge of pond and install temporary soil stabilization measures on disturbed soils. This notice is issued in accordance with Section 14 of the Town of Waterford Inland Wetlands and Watercourses Regulations. Failure to comply with the terms of this letter may result in further enforcement action by the Waterford Conservation Commission, including but not limited to the issuance of a cease and desist order or referral to Town counsel for legal action. PROP. conicure FIFTEEN ROPE PERRY ROAD oN, s WATERFORD, CT 06385-2886 WATERFORD CONSERVATION COMMISSION PERMIT #00-07 — Addition 9 Waterview Drive, Waterford, CT Assessor’s Map # 122 Parcel # 008 ‘The Conservation Commission hereby authorizes the applicant to conduct regulated activities in designated areas that fall under the jurisdiction of the Inland Wetlands and Watercourses Act, as amended, Section 22a-36 to 22a-45, inclusive, of the Connecticut General Statutes, This permit is a grant of approval from the Waterford Conservation Commission to conduct the following regulated activities: 1. Construction of a residential building addition adjacent to inland wetlands, 2. Disturbance of 400 sq. ft. of intermittent watercourse for the extension of an existing culvert with flared end. These regulated activities are associated with the proposed construction of a residential building addition on property located at 9 Waterview Drive, Waterford, Connecticut. ‘The proposal is shown on site plans entitled “Property of Brian D. Klee & Diane M. Davidson, 9 Waterview Drive, Waterford, CT; dated April 1999 as revised through April 7, 2000, prepared by CLA Engineers, Inc. ‘The Conservation Commission has reviewed the plans and documents of record and attaches the following conditions to further protect the inland wetlands, surface water and groundwater on this site and to minimize impacts associated with the proposal: SPECIAL CONDITIONS: 1. Construction of the culvert extension shall occur during a dry period and the inlet temporarily blocked to prevent erosion, Sequence of construction shall occur as described in the approved plans. STANDARD CONDITIONS: 2. The limits of clearing for lot development shall be marked in the field by a licensed surveyor and approved by the Commission's agent prior to the start of construction. 4, The Conservation Commission’s agent shall be notified at least 48 hours prior to commencement of any regulated activity. Waterford Conservation Coma. waion Permit #00-07 — 9 Waterview Drive Page 2 4, Final stabilization of disturbed soil areas shall be conducted with the application of loam, seed and appropriate crosion control measures, 5, Atall times during site work and until soil areas are stabilized, the applicant shall install and maintain erosion and sediment control measures such as fabric filter fence, staked hay bales or other measures deemed necessary by the Commission’s agent. 6. Erosion control and soil stabilization measures shall comply with the approved plans and should follow guidelines as established in the Connccticut Guidelines For Soil Erosion and Sediment Control. 7, Upon direction of the Commission’s agent, erosion and sediment control measures shall be removed by the applicant following stabilization of the site. 8, All work and all regulated activities conducted pursuant to this authorization shall be consistent with the terms and conditions of this permit, Any structures, excavation, fill, obstructions, encroachments or regulated activities not specifically identified and authorized herein shall constitute a violation of this permit and may result in permit modification, suspension or revocation, 9, In the event that any additional wetland or watercourse regulated activities are required as a result of other agency permitting to support the proposed facility, the Waterford Conservation Commission reserves the right to reconsider development of this site and may require design modifications to minimize the impact to regulated resources. In evaluating this application, the Commission has relied on information provided by the applicant, If such information subsequently proves to be false, incomplete and/or inaccurate, this permit shall be modified, suspended or revoked. This permit shall be valid for a period of 2 years. Once initiated, the regulated activity shall be completed within one year. If the regulated activity is not completed within this time frame, the permit may be held to be invalid by the Conservation Commission and the applicant may be required to petition the Commission for an extension or re-issuance of the permit. The Commission may require the applicant to furnish additional information at that time. The Conservation Commission renders this Summary Ruling in accordance with the Waterford Inland Wetlands and Watercourses Regulations based on the following considerations: A. The proposed activity involves minimized impacts to a watercourse for extension of an existing culvert. B, Strict adherence to the conditions imposed with this permit will protect the quality of wetlands and surface waters on the subject property, This permit will be strictly enforced. If the Conservation Commission finds that the applicant has not complied with the permit conditions or has exceeded the scope of this permit as set forth Waterford Conservation Com.. ion Permit #00-07 - 9 Waterview Drive Page 3 herein, or if the intended use of the general site is not as represented by the application or the plan of record, the Commission may suspend or revoke this permit, direct the Environmental Officer to issue a cease and desist order, require the applicant to modify, extend or revise the site worl, or require the applicant to restore the area to its original condition.
