Re: Unauthorized Grading & Clearing of Stream Channel
52 Gurley Road, Waterford
Mr. Reagan,
This letter is a notification that you have conducted activity within and adjacent to a watercourse
located on and adjacent to the northeast portion of your property at 52 Gurley Road, Waterford
in violation of Section 6 of the Waterford Inland Wetlands & Watercourses Regulations.
A site visit was conducted with you on August 30, 2023. It was observed that grading has been
conducted along the western channel bank extending approximately 100 feet south of the culvert
under Gurley Road. Recently graded soil was evident along the channel edge and adjacent lawn
area with newly germinated grass seed. Refer to attached photos taken on August 30, 2023.
This activity has not been authorized by the Waterford Conservation Commission and is in
violation of the Waterford Inland Wetlands & Watercourses regulations.
By this letter, you are requested to:
1. Contact the Waterford Planning & Development office within 7 days of your receipt of this
notice to discuss required restoration measures to stabilize the channel bank and restore a
vegetated border along the watercourse.
2. Within 30 days of receipt of this notice, submit a channel stabilization and restoration plan to
stabilize the graded portion of the channel against erosion and restore native riparian
vegetation along the disturbed portion of the stream channel. The restoration plan is to be
submitted to the Environmental Planner. The restoration plan will be reviewed by the
Waterford Conservation Commission for approval or modification.

This notice is issued in accordance with Section 14 of the Town of Waterford Inland Wetlands
and Watercourses Regulations. Failure to comply with the terms of this letter may result in
further enforcement action by the Waterford Conservation Commission, including but not
limited to the issuance of a cease and desist order or referral to Town counsel for legal action.
