Peter and Kathleen Bergeron are hereby requesting to modify the non-
encroachment buffer on our property at 39 Shore Road Waterford, CT 06385.
We request authorization to clear and grade the Northwest corner of our
backyard to support the installation of our inground family pool (see photo and
grading plan excerpt). After construction of said pool, all erosion and soil
grading/stabilization shall be in accordance with the original Waterford
Conservation Commission Permit No. 96-04 dated March 14, 1996.
We also request that a number of existing trees (see photo) and brush be
cut down on the West side of our home’s backyard. We recently purchased this
property in December 2020 and these trees are extremely mature (tall) and are
an imminent threat to damage our home should they fall.
In consideration of the above, we believe that the above activities will not
affect the nearby wetlands as the wetlands are in the adjacent protected space
(see Grading Plan Excerpt of the Cluster Division).

WATERFORD CONSERVATION COMMISSION
Permit No. 96-04 Issued To Shore Road Development
Assessor's Map 61-A and 61-D, Parcel 32 and 29, 37 Shore Road
The Commission hereby authorizes the applicant to conduct
regulated activities in designated areas which fall under the
jurisdiction of the Inland Wetlands and Watercourses Act, as
amended, Section 22a-36 to 22a-45, inclusive, of the Connecticut
General Statutes.
This permit is a grant of approval from the Waterford
Conservation Commission to conduct the following requested
regulated activities:
i. Construction of 5 residential structures adjacent to inland
wetlands as part of a 6 lot subdivision.
2. Disturbance and filling of 0.02 acres of wetlands for the
construction of a drainage system and discharge of
groundwater to a watercourse.
All site activities shall be conducted in accordance with the
plans, specifications and documents of record. Any deviation
from the approved plans or construction sequence shall be cause
for enforcement action by the Conservation Commission.
The Conservation Commission has reviewed the plans of record and
the file documents and attaches the following conditions in order
to further protect the inland wetlands and groundwater on this
site and to minimize impacts associated with the proposal:
1. Limits of clearing shall be flagged in the field and
verified by the Planning Department prior to initiation of
work.
Q's The wetlands buffers shown on the subdivision plan shall be
designated as the non-encroachment line beyond which any
clearing, building or grading is prohibited without prior
approval of the Waterford Conservation Commission.
3. All proposed drainage work shall be stabilized prior to
allowing the discharge of water.

4. At all times during site work and until exposed areas are
stabilized, the applicant shall install and maintain erosion
and sediment control measures such as staked hay bales and
fabric.filter fences, and such other measures as deemed
necessary by the Environmental Enforcement Officer. Such
protective measures shall be installed and maintained to the
satisfaction of the Environmental Officer.
5. Erosion control and soil stabilization shall follow
guidelines as established in the Connecticut Guidelines for
Soil Erosion and Sediment Control.
6. The Environmental Enforcement Officer must be notified at
least 48 hours prior to commencement of any permitted site
work.
vin This permit shall be valid for five years, however once the
regulated activity has been initiated, it shall be completed
within 1. year. If the work is not completed within this
time, the permit may be held to be invalid by the
Commission. The applicant may be required to petition the
Commission for reissuance of the permit. The Commission may
required the applicant to furnish additional information at
that time.
8. No materials may be deposited and no activities may be
conducted in any regulated areas except for those specified
in this permit in accordance with plans and documents
submitted as part of the application.
The Commission renders this Summary Ruling based on the following
considerations:
A. Strict adherence to the conditions imposed: with this
permit will protect the quality of surface and ground-
waters on the subject property.
B. Alternatives have been considered by the Commission and
the permitted proposal represents the activity with the
least impact.
This permit will be strictly enforced. The Commission may
suspend or revoke this permit, may direct the Environmental
Enforcement Officer to issue a cease and desist order or may
require the applicant to modify, extend, or revise. the site work
or restore the area to its original condition if it finds that
the applicant has not completed with the conditions set forth in
this permit or if the applicant exceeds the scope of this permit

general site is not as represented by the application or the plan
of record.
