Maidelis called the meeting to order at 3:03 p.m. Wade Thomas and Julie Wainscott were seated for the vacant positions. 2, APPROVAL of the May 28, 2020 Meeting Minutes Motion: Motion made by J. Wainscott, second by M. Stankov to approve the May 28, 2020 meeting minutes. Vote: 5-0 3, APPLICATION REVIEW C-20-07 35 Pepperbox Road — Garage — Rich Gonyo — Owner & Applicant Rich Gonyo and Cathy Newlin were present. Staff reviewed a draft permit with the Commission. Motion: Motion made by G. Renegar, second by W. Thomas to approve the draft permit prepared for application #C-20-7 as written. Vote: 5-0 R. Muckle joined the meeting at 3:15 pm. C-20-08 15 Leary Drive — In-Ground Pool — Kimberly Devlin/Robert Brule — Owner & Applicant R. Brule reviewed the application with the Commission, noting his lot is % wetland and he has maintained compliance with the permit for 20 years. He noted he is asking for a reasonable accommodation to use his yard. The size of the pool is 14 x 30 feet with a minimum concrete pad around the edges. He explained to the Commission that his rear yard is 12 feet deep. He is requesting to limit the disturbance enough for a pool and to remove 5 dead trees. Commission members asked if test pits, grading and erosion controls were considered and if moving the pool closer to the existing shed would minimize impacts. R. Brule replied he has not developed a grading plan yet and moving the pool closer to shed is the lower part of the property, he is trying to keep the pool away from the rear door. R. Muckle asked if a wetland impact study was done. R Brule replied not to his knowledge. Conservation Commission Minutes June 11, 2020 p. 2 of 2 Commission members discussed removal of the dead trees. Motion: Motion made by M. Stankov, second by J. Wainscott to authorize the removal of requested trees. Vote: 6-0 T. Maidelis directed the applicant to contact staff for requirements of an impact study. C-20-09 446 Boston Post Road — Redevelopment of Existing Filling Station - PMG Coop, LLC, Applicant, Petroleum Marketing Group, LLC, Owner, David T. Faist, Agent Staff reviewed findings and draft conditions for approval in a June 8, 2020 memorandum. Motion: Motion made by M. Stankovy, second by R. Muckle to approve application # C- 20-09 with conditions as written. Vote: 6-0 4, CORRESPONDENCE Notice of Violation — Inland Wetland Permit #C-13-5, Excavation & Fill in Inland Wetlands, 16 Susan Terrace, Waterford, CT Staff reviewed the Notice of Violation and corrective actions completed to date. She asked for authorization to approve the wetland re-planting plan on behalf of the Commission. Motion: Motion made by W. Thomas second by G. Renegar to authorize staff to approve a wetland planting plan. Vote: 6-0 Niantic River Watershed Protection Plan — Update Staff referred the Commission to the drafted update of the Niantic River Watershed Plan and to forward any questions or comments to the Planning Department for transmittal to the Watershed Committee. 5.
