ETHICS COMMISSION Special Business Meeting = MINUTES _ June 3, 2021 Page 1 Call to Order: = The June 3, 2021 Special Business Meeting of the Ethics Commission was called to order at 7:04PM by Marty Zeldis, Chairman. Present: Marty Zeldis, Mark Burnham, Betsy Ritter, Steve Garvin, Olga Bush Excused: Cindy Hersom, Laurie Wolfley Approval of Minutes: S. Garvin moved to approve the meeting minutes of the April 6, 2021 Special Business Meeting. B. Ritter seconded. The minutes as written were accepted unanimously. (5-0). Review of Correspondence No correspondence to review at this time Old Business Items 4a thru 4c: The Commission discussed the Advisory Opinion in draft form. Corrections and revisions were made to several sections. B. Ritter committed to making the revisions as requested and will send a copy to the members for review and evaluation. M. Zeldis to send the revised copy to Attorney Avena for review at the next scheduled meeting. A motion was made by S. Garvin relative to acceptance of the revised draft copy of the Advisory Opinion with an understanding it will be referred to Atty Avena for review and discussion. Seconded B. Ritter. Unanimous (5-0). At 7:55PM, the Commission voted to go into Executive Session for the purpose of discussion related to the items of Old Business. Motion by S. Garvin. Seconded by M. Burnham. Unanimous (5-0). The Commission finished the Executive Session at 8:05 PM. A motion was made by M. Zeldis to end the Executive Session. Seconded by M. Burnham. Unanimous (5-0). No votes were taken in the session. Discussion related to the issue of probable cause was decided by vote. A motion made by S. Garvin - Do we have sufficient probable cause to determine if the Respondent violated the Waterford Code of Ethics? Seconded by M. Burnham. ETHICS COMMISSION Special Business Meeting MINUTES June 3, 2021 Page 2 The vote was by roll: O.Bush - abstained, M. Burnham - No, B. Ritter - No, S. Garvin - No, M. Zeldis - No. The motion passed. Chairman Zeldis to review and seek advisement from Attorney Avena related to the details of the Advisory Opinion and matters pertaining to probable cause. The next meeting will be held June 29th at 7PM. Adjournment: At 8:16 PM B. Ritter made a motion to adjourn the meeting. Seconded by S. Garvin. Unanimous decision (5-0).
