1. CALL TO ORDER AND APPOINTMENT OF ALTERNATES
The meeting was called to order at 6:32p.m. I. Plis was seated for M. Keatley.
2. APPROVAL OF THE December 8, 2022 MEETING MINUTES
Motion: Motion made by T. Maidelis, second by W. Thomas to approve the December 8,
2022 meeting minutes, with a correction noted under new applications for
application C-22-14, 109R & 131 Clark Lane, under discussion, sentence two, to
read “Attorney Branse noted he does NOT see what activity would constitute a
significant impact”.
Vote: 4-0-0
3. NEW APPLICATIONS
C-22-15, 130R Great Neck Road, New construction single family home and outbuilding, Dan
Russ, Owner; David Balfour, Applicant/Agent
D. Balfour reviewed his plan to construct a single family home and outbuilding and extend a
driveway to the eastern portion of the property. An existing driveway is located in the west
portion and extends as a pathway into the lot. He is looking to establish a 15 ft. wide driveway
and clearing limits. Staff comments noted the driveway shown on the survey is not 15 ft. wide
and that the limits of clearing for the driveway and utility installation need to be shown on a
revised driveway plan with the temporary disturbance for utilities. Staff noted a permit was
issued for a culvert crossing of the wetland in 1984. The application is to upgrade the driveway,
install utilities and build a house. The isolated wetland is noted to contain a vernal pool. The
driveway is proposed to be gravel without curbs.
Commissioners questioned the separation distance between the water and sewer lines in the
utility trench. Staff requested a revised driveway plan showing the driveway construction, and
sideslopes, the utility trench and the limits of clearing and disturbance. The Commission
accepted the application.
4, APPLICATION REVIEW

No discussion. A public hearing is scheduled for January 26, 2023.

5. VIOLATIONS
407 Boston Post Road: Unauthorized Fill Within and Adjacent to Inland Wetlands &
Watercourse.
Staff discussed that trees were cut and debris and fill deposited in the wetland on the adjoining
property. The owner has met with staff and the extent of wetland encroachment was measured
between 10 and 13 feet into the wetland. The owner of 407 Boston Post Road was given sixty
days to submit a restoration plan. Staff noted the plan must be acceptable to the adjacent
property owner on whose land the material was deposited.
207 Waterford Parkway North: Unauthorized clearing & mowing within and adjacent to
Inland Wetlands, Notice of Non-Compliance issued December 5, 2022.
Staff explained that the owners had trees and brush bordering the wetland cut and the material
was deposited down the embankment into the wetland channel. The wetland channel extends
under Parkway North and is bordered by fill on the site. The owner has been directed to remove
the material from the wetland and chip it outside of the wetland area. Staff asked if any other
restoration measures would be required by the Commission.
Commission members agreed the material should be removed from the wetland, disposed of, and
the exposed soil areas seeded to restore vegetative cover.
6. OTHER BUSINESS
205 Butlertown Road: Request to cut trees in wetland, Section 4.1 d, determination request.
Staff reviewed the location of the trees being requested to be cut in the wetlands.
Motion: Motion made by W. Thomas, second by I. Plis to find that the proposed tree
cutting is considered a permitted use as of right under section 4.1.d. of the
regulations.
Vote: 4-0-0
Election of officers:
Motion: Motion made by W. Thomas, second by I. Plis to nominate R. Muckle for
Commission Chair and T. Maidelis for Commission Secretary for 2023.
Vote: 4-0-0
No other nominations were made.
Motion: Motion made by I. Plis, second by W. Thomas to close the nominations.
Vote: 4-0-0
