1. CALL TO ORDER AND APPOINTMENT OF ALTERNATES
W. Thomas sat for Chairman and called the meeting to order at 6:30 p.m. J. Wainscott was seated for T.
Maidelis.
2. APPROVAL of the November 5, 2020 MEETING MINUTES
Motion: Motion made by D. Lersch, second by G. Renegar to approve the November 5,
2020 meeting minutes.
Vote: 5-0-1 (J. Wainscott abstained from the vote)
3. APPLICATION REVIEW
C-20-14 14B Shore Road _— Request to Increase Paved Width of Driveway and Modify Culvert
Crossing with Longer Pipe — Killingly Engineering Associates, Agent
R. Muckle joined the meeting at 6:34 p.m.
Dave Reagan, Reagan Homes, and Ian Cole, soil scientist, were present for the meeting. D. Reagan
apologized for the unauthorized culvert activity and stated that there was a miscommunication that had
happened but as the general contractor on the job he is taking responsibility for the unpermitted work.
Commissioners asked what was the property owner willing to submit for mitigation. I. Cole noted that
field measurements taken earlier in the day indicate that approximately 3,900 sq. ft. of wetland mitigation
area was created, versus the 2,900 sq. ft. of mitigation required per the permit. An as-built survey will be
conducted next week to determine actual wetland impact and mitigation area. The proposed engineered
plan indicates an additional 300 sq. ft. of wetland impact from the modification to the driveway culvert
crossing. From field measurements, there is an additional 1,000 sq. ft. of mitigation area already. 1. Cole
noted he is uneasy to go back into the mitigation area at this time and disturb the soils and suggested there
may be opportunity for on-site wetland enhancement.
Staff noted the Commission will need to consider whether the additional wetland mitigation area already
created is sufficient to address the additional wetland impact and asked what was the quality of the
wetland impact area. I. Cole noted it was a man-made artificial channel for conveyance of flow.
The Commission requested the actual area of additional wetland disturbance, the area of created wetland
and the applicant’s proposal for mitigation of the unauthorized wetland fill for the next scheduled
Conservation Commission meeting. The application was continued to the December 10, 2020 meeting.

Motion: Motion made by D. Lersch, second by J. Wainscott to approve the draft permit.

4, NEW APPLICATIONS
C-20-18 184 Boston Post Road — Pond Maintenance (Duck Pond) — Town of Waterford
Brian Flaherty, Director of Recreation & Parks was present for the application and reviewed the
maintenance request, noting a previous maintenance permit was issued to maintain the inlet and outlet of
the pond. Staff explained the maintenance permit is expiring so the request is for a new permit, with
additional maintenance areas requested to remove leaves and fallen branches and accumulated sediment.
Motion: Motion made by D. Lersch, second by R. Muckle to have staff draft a permit to conduct
maintenance of the pond as requested.
Vote: 7-0
5. VIOLATIONS
14B Shore Road — Unauthorized Culvert Installation and Fill Placement within Wetlands and
Watercourses — Notice of Violation November 12, 2020
The Commission discussed the violation earlier in the meeting while discussing the proposed
modification. J. Wainscott asked if mitigation could be proposed for the spring as the planting season has
ended for the year. W. Thomas noted the Commission is waiting for the survey information and the
owner’s proposal for mitigation of unauthorized wetland impact.
6. OTHER BUSINESS
No other business was discussed.
vi CORRESPONDENCE
The Commission discussed the renewal of the Connecticut Land Conservation Council.
Motion: Motion made by D. Lersch, second by J. Wainscott to renew the membership to the
Connecticut Land Conservation Council for $100.00
Vote: 7-0
The Commission discussed the CACIWC Annual Meeting registration.
8. PAYMENT OF BILLS
No bills were discussed.
