1. CALL TO ORDER AND APPOINTMENT OF ALTERNATES
Chairman Muckle called the meeting to order at 6:30 p.m. Ivy Plis was seated for W. Thomas
and J. Wainscott was seated for M. Stankov.
2. APPROVAL of the January 28, 2021 MEETING MINUTES
Motion: Motion made by T. Maidelis, second by G. Renegar to approve the January 28,
2021 meeting minutes.
Vote: 7-0
3. APPLICATION REVIEW
No applications were discussed.
4, NEW APPLICATIONS
C-21-1_ 55 & 65 Rope Ferry Road — Invasive Species Management/Wetland Restoration Plan —
Brian Flaherty, Applicant, Town of Waterford, Owner
Staff reviewed with the Commission the application materials.
J. Wainscott questioned if there will be changes to the walkway. Staff noted there is an existing
footpath.
D. Lersch noted that the proposal will be an improvement to Town property.
Motion: Motion made by T. Maidelis, second by J. Wainscott have staff prepare a draft
permit for approval at the next meeting.
Vote: 7-0
5. VIOLATIONS
54 Rope Ferry Road — Unauthorized Clearing of Vegetation and Soil Grading Within and
Adjacent to Intermittent Watercourse at Rope Ferry Condominiums — Notice of Violation dated
February 5, 2021
Kathy Snyder, Cheryl Sirpenski, and Jack Cunningham were present as representatives of the
Rope Ferry Commons Condominium Association. Mr. Cunningham apologized for the work
that occurred, noting they did not believe a permit was needed. He explained that the intent was
to clear the channel and to improve flow and reduce odors. A small backhoe was used to push
and pull material out of the channel.

D. Lersch requested a wetland restoration plan be prepared to restore wetland function. The
owners may need to hire a third party to create a plan. T. Maidelis also requested a remedial
plan be submitted. I. Plis suggested the plan find some middle ground for keeping the water
flowing and eliminate the stagnant conditions.
Staff requested time to review the area, document what was conducted and if any immediate
stabilization measures are required, to direct the association to implement those measures. Due
to frozen ground and snow cover, more time will be needed to evaluate the site conditions.
The homeowner’s association members authorized staff to review the property.
The violation discussion was continued to the next scheduled meeting.
14B Shore Road — Unauthorized Culvert Installation and Fill Placement within Wetlands and
Watercourses — Notice of Violation November 12, 2020 — Wetland Enhancement Plan to be
submitted by May 31, 2021 and implemented within 90 days of approval.
Staff reported that she had received notification from the builder that a wetland scientist has been
hired to prepare a wetland enhancement plan.
6. OTHER BUSINESS
21 Sixth Avenue — Determination of Permit Requirement
Staff reviewed with the Commission a building permit application that was submitted to build a
11 x 18 pole shed. The proposed shed does not include any fill in wetlands.
Motion: Motion made by D. Lersch, second by G. Renegar to find that proposed shed be
approved under Section 4.1(d) of the Inland Wetlands and Watercourses
Regulations of the Town of Waterford.
Vote: 7-0
7. CORRESPONDENCE
No correspondence was discussed.
8. PAYMENT OF BILLS
Motion: Motion made by T. Maidelis, second by J. Patterson to pay the bill from The Day
in the amount of $84.00.
Vote: 7-0
9. ADJOURNMENT
Motion: Motion made by J. Wainscott, second by T. Maidelis to adjourn at 7:09 pm.
