. Senior Services: To consider and act on the following request for a FY23 In-
Series Transfer from the Director of Finance, Kimberly Allen, in the amount
of $2,280, for mental health/emotional well-being services provided by a
contractual licensed clinical social worker.
. Tax Collector: To consider and act on the following request for a FY23 Out-
of-Series Transfer from the Tax Collector, Allen Wilensky, in the amount of
$75.00, for cost of postage, forward on to the Board of Finance if approved.
10. Finance Department: To consider and act on participating in the new National
Opioid Settlements with Teva, Allergan, CVS, Walgreens and Walmart and
have the First Selectman sign and return the Participation Form on or before
April 18, 2023.
11. Police Department Police Cruiser Aftermarket Equipment: To consider
and act on a request from Shea Moses, Purchasing Agent, in accordance with
the Purchasing Ordinance sections 3.08.030 and 3.08.040, to award MHQ, Inc.,
our current vendor, Police Cruiser Aftermarket Equipment #23-117, in the
amount of $32,228 for equipment and services. Funds will be available from
the vehicle fleet line #24207-54020, and forward on to the Board of Finance if
approved,
12. Fire Station Building Committee: To appoint a member of the Board of
Selectman to serve on the Fire Station Building Committee, established by the
Representative Town Meeting.
13. Disposition of Property: To consider and act on a request by the Board of
Selectmen to the Representative Town Meeting for the disposition of town
owned real property at 1 Hamel Court, by auction.
14. Appointments & Resignations:
JAa. To appoint Doris Crum to the Planning and Zoning Commission as an
Alternate Member to serve the term from 7/1/22-6/30/25.
14b, To appoint Nancy Sugrue to the Waterford Town Center Development
Ad Hoc Committee.

Dear Chairman Patterson,
On behalf of the Board of Assessment Appeals, | would like to respectfully request an additional appropriation of $2,235
to assist the Board with fulfilling their duties regarding the completion of the 2022 revaluation. To date, the Assessor’s
office has received 109 appeal applications and with the extended date to file of March 20, 2023, we expect the number
of appeals to increase. A motion to request the one-time funding for the temporary membership and pay increase was
made at the Board of Assessment Appeals meeting on Thursday, September 15, 2022. The motion was voted on, and
was passed unanimously.
On December 5, 2022 the RTM voted to appoint two additional members to the Board of Assessment Appeals for a term
of one year.
Line item 10105-51010 (Elected Officials) is currently $300; this is commonly reserved for the three regular members
who each receive $100 in a typical grand list year (approximately 30-40 hearings.) An additional $1,200 is being
requested to increase this line item to $1,500. This would allow each of the five members to receive $300 for their
participation in the hearings (during a revaluation year we are expecting 150-200 hearings.}
Line item 10105-51210 (Clerical and Technical) is currently $553.36, which also needs to be increased. We are expecting
the Clerk for the Board to work approximately 40 hours at an hourly rate of $33.09 (time and a half per the 1303 union
contract) which equates to $1,323.60. We would like to request an additional $770.24 for this line item to satisfy the
salary for the BAA Clerk.
Line item 10105-52020 (Postage) is currently $50.00, which would need to be increased to $154, based on the amount
of appointment notices and decision letters that are required to be sent out to the appellants.
Line item 10105-51920 (FICA) is currently $65.24, which would need to be increased to $226 to satisfy the FICA for the
clerk and BAA members.

Jam requesting an additional appropriation for two department accounts: 10103 ~ Board of
Finance and 10107 — Finance Department.
1. An additional appropriation in the amount of $7,298 for line 10103-52030 (Professional
Fees). The FY22 audit was higher than anticipated and budgeted due to new GASB 87
requirements regarding leases. The new requirement increased costs to complete the
annual audit.
2. An additional appropriation in the amount of $5,841 for line 10107-51110
(Administration). The funds are needed for an employee payout that was required per a
negotiated contract.

Five new proposed national opioid settlements (“New National Opioid Settlements”)
have been reached with Teva, Allergan, CVS, Walgreens, and Walmart
(“Settling Defendants”). This Participation Package is a follow-up communication to
the Notice of National Opioid Settlements recently received electronically by your
subdivision or special district (“subdivision”).
You are receiving this Participation Package because Connecticut is participating in
the following settlements:

If a state does not participate in a particular Settlement, the subdivisions in that
state are nat eligible to participate In that Settlement.
This electronic envelope contains:
* Participation Forms for Teva, Allergan, CVS, Walgreens, and Walmart,
including a release of any claims.
The Participation Form for each settlement must be executed, without
alteration, and submitted on or before April 18, 2023, in order for your
subdivision to be considered for initial participation calculations and
payment eligibility.
Based upon subdivision participation forms received on or before April 18th, the
subdivision participation rate will be used to determine whether participation for
each deal Is sufficient far the settlement to move forward and whether a state earns
its maximurn potential payment under the settlement. ff the settlement moves
forward, your release will become effective. If a settlement does not move forward,
that release will not become effective.

Any subdivision that does not participate cannot directly share in the settlement
funds, even if the subdivision’s state is settling and other participating subdivisions
are sharing in settlement funds. Any subdivision that does not participate may also
reduce the amount of money for programs to remediate the opioid crisis in its state,
Please note, a subdivision will not necessarily directly receive settlement funds by
participating; decisions on how settlement funds will be allocated within a state are
subject to Intrastate agreements or state statutes.
You are encouraged to discuss the terms and benefits of the New Natlanal Opioid
Settlements with your counsel, your Attorney General’s Office, and other contacts
within your state. Many states are Implementing and allocating funds for these new
settlements the same as they did for the prior opioid settlements with McKesson,
Cardinal, Amerisource, and J&/Janssen, but states may choose to treat these
settlements differently.
Information and documents regarding the New National Oploid Settlements: and
how they are being implemented In your state and how funds will be allocated
within your state allocation can be found on the national settlement website at
https://nationalopioidsettiement.cam/. This website will be supplemented as
additional documents are created,
How to return signed forms:
There are three methods for returning the executed Participation Forms and any
supporting documentation to the Implementation Administrator:
(1) Electronic Signature via DocuSign: Executing the Participation Forms
electronically through DocuSign will return the signed forms to the
Implementation Administrator and associate your forms with your
subdivision’s records. Electronic. signature is the most efficlent method for
returning Participation Forms, allowing for more timely participation and the
potential to meet higher settlement payment thresholds, and is therefore
strongly encouraged.
(2) Manual Signature returned via DocuSign: DocuSign allows forms to be
downloaded, signed manually, then uploaded to DocuSign and returned
automatically to the Implementation Administrator. Please be sure to
complete ail fields. As with electronic signature, returning manually signed
Participation Forms via DocuSign will associate your signed forms with your
subdivision’s records.
(3) Manual Signature returned via electronic mail: \f your subdivision is unable to
return executed Participation Forms using DocuSign, signed Participation
Forms may be returned via electronic mail to
oploidsparticipation@rubris.cam. Please include the name, state, and
reference ID of your subdivision in the bady of the email and use the subject
line Settlement Participation Forms - [Subdivision Name, Subdivision State] -

The governmental entity identified above (“Governmental Entity”), in order to obtain and in
consideration for the benefits provided to the Governmental Entity pursuant to the Agreement dated
November 22, 2022 (“Allergan Settlement”), atid acting through the undersigned authorized official,
hereby elects to participate in the Allergan Settlement, release all Released Claims against all Released

Plaintiffs’ Executive Committee to execute and file.on behalf of the Governmental Entity a.

unconditionally, and ixrevecably covenants not to bring, file, or claim, or to cause, assist in
bringing, or permit to be brought, filed, or claimed, or to otherwise seek to establish Hability
for any Released Claims against any Released Entity in any forum whatsoever. The releases
provided for in the Allergan Settlement are intended te be broad and shall be interpreted so as
fo give the Released Entities the broadest possible bar against any liability relating in any way
to Released Claims and extend to the full extent of the power of the Governmental Entity to
release. claims. The Allergan Settlement shall be a complete bar to any Released Claim.
The Governmental Entity hereby takes on all rights and obligations of a Participating
Subdivision or Participating Special District as set forth in the Allergan Settlement,
In connection with the releases provided for in the Allergan Settlement, each Governmental
Entity expressly waives, releases, and forever discharges any and all provisions, rights, and
benefits conferred by any law of any state or territory of the United States or other jurisdiction,
or principle of common law, which is similar, comparable, or equivalent to § 1542 of the
California Civil Code, which reads:
. General Release; extent. A general release-does not extend to claims that the
creditor or releasing party does not know or suspect to exist in his or her favor
at the time of executing the release that, if known by him or her, would have
materially affected his or her settlement with the debtor or released party.
A Releasor may hereafter discover facts other than or different from those which it knows,
believes, or assumes to be true with respect to the Released Claims, but each Governmental
Entity hereby expressly waives and fully, finally, and forever settles, releases and discharges,
upon the Effective Date, any and all Released Claims that may exist as of such date but which
Releasors do not know or suspect to exist, whether through ignorance, oversight, error,
negligence or through uo fault whatsoever, and which, if known, would materially affect the
Governinental Entities’ decision to participate in the Allergan Settlement,

official, hereby elects to participate in the Teva Settlement, release all Released Claims against all
Released Entities, and agrees as follows,
1. The Governmental Entity is aware of and has reviewed the Teva Settlement, understands that
all terms in this Election and Release have the meanings defined therein, and agrees that by
this Election, the Governmental Entity elects to participate in the Teva Settlement as provided
therein,
2. Following the execution of this Settlement Participation Form, the Governmental Entity shall
comply with Section IILB of the Teva Settlement regarding Cessation of Litigation Activities.
3, The Governmental Entity shall, within 14 days of the Reference Date and prior to the filing of
the Consent Judgment, file a request to dismiss with prejudice any Released Claims that it has
filed. With respect to any Released Claims. pending in In re National Prescription Opiate
Litigation, MDL No. 2804, the Governmental Entity authorizes the Plaintiffs’ Executive
Committee to execute and file on behalf of the Governmental Entity a Stipulation of Dismissal
With Prejudice substantially in the form found at https://nationalopioidsettlement.com.
4. The Governmental Entity agrees to the terms of the Teva Settlement pertaining to
Subdivisions as defined therein.
5. By agreeing to the terms of the Teva Settlement and becoming a Releasor, the Governmental
Entity is entitled to the benefits provided therein, including, if applicable, monetary payments
béginsing after the Effective Date,
6, The Governmental Entity agrees fo use any monies it receives through the Teva Settlement
solely for the purposes provided therein.
7. The Governmental Entity submits to the jurisdiction of the court in the Governmental Entity’s
state where the Consent Judgment is filed for purposes limited to that court’s role as provided
in, and for resolving disputes to the extent provided in, the Teva Settlement,

The Governmental Entity has the right to enforce the Teva Settlement as provided therein.
The Governmental Entity, as a Participating Subdivision or Participating Special District,
hereby becomes a Releasor for ali purposes in the Teva Settlement, including but not limited
to all provisions of Section V (Release), and along with all departments, agencies, divisions,
boards, commissions, districts, instramentalities of any kind and attomeys, and any person in
their official capacity elected or appointed to serve any of the foregoing and any agency,
person, or other entity claiming by or through any of the foregoing, and any other entity
identified in the definition of Releasor, provides for a release to the fullest extent of its
authority. As a Releasor, the Governmental Entity hereby absolutely, unconditionally, and
irrevocably covenants not to bring, file, or claim, or to cause, assist or permit to be brought,
filed, or claimed, or to otherwise seek to establish liability for any Released Claims against
any Released Entity in any forum whatscever. The releases provided for in the Teva
Settlement are intended by Released Entitles and the Governmental Entity to be broad and
shall be interpreted so as to give the Released Entities the broadest possible bar against any
liability relating in any way to Released Claims and extend to the full extent of the power of
the Governmental Entity to release claims. The Teva Settlement shall be a complete bar to
any Released Claim.
The Governmental Entity hereby takes on all rights and obligations of a Participating
Subdivision or Participating Special. District as set forth in the Teva Settlement,
In connection with the releases provided for in the Teva Settlement, each Governmental Entity
expressly waives, releases, and forever discharges any and all provisions, rights, and benefits
conferred by any law of any state or territory of the United States or other jurisdiction, or
principle of cornmon law, which is similar, comparable, or equivalent to § 1542 of the
California Civil Code, which reads:
General Release; extent. A general release. does not extend to claims
that the creditor or releasing party does not know or suspect to exist in
his or her favor at the time of executing the release that, if known by
him or her, would have materially affected his or her settlement with
the debtor or released party.
A Releasor may hereafter discover facts other than or different from those which it knows,
believes, or assumes to be true with respect to the Released Claims, but each Governmental
Entity hereby expressly waives and fully, finally, and forever settles, releases and discharges,
upon the Effective Date, any and all Released Claims that may exist as of such date but which
Releasors do not know or suspect to exist, whether through ignorance, oversight, error,
negligence or through no fault whatsoever, and which, if known, would materially affect the
Governmental Entities’ decision to participate in the Teva Settlement.
Nothing herein is intended to modify in any way the terms of the Teva Settlement, to which
Governmental Entity hereby agrees. To the extent this Election and Release is interpreted
differently from the Teva Settlement in any respect, the Teva Settlement controls,

Dear First Selectman Brule,
My name is Kate Ericson, and | am the Executive Director of LEARN, a regional educational service center
located in Old Lyme, Connecticut. As you may know, LEARN is one of six regional educational service
centers (RESCs) established by the state legislature to collaborate with school districts and provide
programs and services supporting teachers and students in our region, from Guilford to North
Stonington. In addition, LEARN currently operates four magnet schools in the region, including The
Friendship School on Rope Ferry Road for the past 18 years. The Friendship School was built as a
cooperative agreement between Waterford Public Schools and New London Public Schools and has
been a great success. The school has served up to 520 pre-kindergarten three- and four-year-olds as
well as kindergarten students and engaged with their families and communities. During that time, the
school has transitioned into a full magnet school accepting students from across the region. LEARN has
been aided in these efforts by a great relationship with the Town of Waterford, your office, and the
Waterford Board of Education. As the school approaches the end of its lease term, due to the school’s
success a number of factors have emerged creating certain challenges and opportunities requiring
LEARN to make some strategic shifts in our regional programs that will benefit the students, families,
and districts in our region.
Challenges:
To meet the needs of future generations, we see two major challenges to be resolved. The first major
challenge involves the impact of dropping-off and picking-up students as it relates to the traffic patterns
on Rope Ferry Road, the community center, and the high school complex. While we have worked with
the town to minimize impact, the number of parents transporting their children to school has grown
rapidly in the last few years.
The other major challenge is the lack of early childhood programming in the region for infants and
toddlers. Southeastern Connecticut employment opportunities are exploding, and with that comes the
need for high-quality infant and toddler programs to support such economic growth and development.
Strategic Solutions:
While The Friendship School has a long history of serving young learners from Waterford and across
Southeastern Connecticut, regional challenges demand a new, innovative response.
