1. CALL TO ORDER AND APPOINTMENT OF ALTERNATES
Chairman Muckle called the meeting to order at 6:30 p.m. J. Wainscott was seated for the
vacancy.
2. APPROVAL of the April 22, 2021 MEETING MINUTES
Motion: Motion made by G. Renegar, second by W. Thomas to approve the April 22, 2021
meeting minutes with noted correction.
Vote: 7-0
3. APPLICATION REVIEW
C-21-02 1000 Hartford Turnpike: Drainage Outlet Swale Extension — Department of Public Works,
Applicant, Anchor Engineering, Agent
Staff reviewed the draft permit.
Motion: Motion made by W. Thomas, second by J. Patterson to approve a draft permit for
approval.
Vote: 7-0
4, NEW APPLICATIONS
C-21-03: 18 Dimmock Road: Residential Addition and Septic Installation Robert & Grace
Kyne, Owner & Applicant, DLC Engineering Services, LLC, Agent
Grace & Robert Kyne, owners, Brian Florek, LS, and David Cooley, PE were available for the
application.
B. Florek explained that the property owners are looking to relocate their existing, older septic
system to a new code compliant septic system and add an addition to the existing home. They
are not proposing adding any additional bedrooms. The work occurs within the upland review
area.
D. Cooley explained that due to health codes and the existing contours of the property the best
location for the system would be at the rear of the house where it is proposed. They are
proposing to be at least 25 feet from the wetlands. The Ledge Light Health District has issued a
conditional approval and the property is connected to municipal water.
B. Florek noted this is not an emergency repair for a failing system and the existing system will
be abandoned.
Commissioners directed staff to prepare a draft permit for their review at their next meeting.

C-21-04: 198 Shore Road: Stream Channel Stabilization — John Lombardi, Applicant; J.
Theroux, Agent;
J. Theroux and J. Lombardi were available for the application. J. Theroux explained that the
property owner is looking to reclaim both sides of the channel from invasive plants and to make
the area more ornamental. They are looking to install plantings on the north and south slopes
and add rip rap at the eroded toe to control erosion.
W. Thomas asked where the transition between tidal wetlands and inland wetlands occurs and if
the activity is regulated by CTDEEP. J. Theroux noted that the transition is somewhere between
wetland flags 13 to 13A on the south bank and wetland flag 17, where the high tide backs up.
J. Theroux noted there will be no direct filling of wetlands. Commissioners asked what is the
square footage and volume of rip rap proposed to be placed. Commissioners asked about the oil
boom that is shown in one of the submitted photographs.
Staff requested the limits of clearing and slope disturbance be indicated. She noted the slopes on
the north are steep and questioned how the rip-rap will be placed at the toe. W. Thomas asked if
an excavator will be going up and down the slope to place the material and if coir logs and
plantings were considered to stabilize the toe.
J. Theroux noted that measure would not work to stop the erosion.
The application was received. Staff will coordinate with commission members for site reviews.
5. VIOLATIONS
54 Rope Ferry Road — Unauthorized Clearing of Vegetation and Soil Grading Within and
Adjacent to Intermittent Watercourse at Rope Ferry Condominiums — Notice of Violation dated
February 5, 2021
D. Turner, Turner Environmental, LLC and Chery] Sirpenski were available for the discussion.
D. Turner reviewed the proposed wetland restoration plan.
Motion: Motion made by W. Thomas, second by J. Wainscott to approve the restoration
plan.
Vote: 7-0
6. OTHER BUSINESS
Staff discussed with the Commission the Town’s intent to apply for a grant from the Long Island
Sound Futures Fund for assistance in repairing the Jordan Millpond fish ladder. The
Commission agreed to have staff prepare a letter of support from the Commission to be signed
by the Chairman.
