1. CALL TO ORDER AND APPOINTMENT OF ALTERNATES
T. Maidelis called the meeting to order at 6:30 p.m. J. Wainscott was seated for R. Muckle and I.
Plis was seated for the vacancy.
2. APPROVAL of the May 13, 2021 MEETING MINUTES
Motion: Motion made by J. Wainscott, second by J. Patterson to approve the May 13, 2021
meeting minutes.
Vote: 6-0-1 (I. Plis)
3. APPLICATION REVIEW
C-21-03: 18 Dimmock Road: Residential Addition and Septic Installation Robert & Grace
Kyne, Owner & Applicant, DLC Engineering Services, LLC, Agent — Review Draft Permit
I. Plis recused herself from the discussion and vote for 18 Dimmock Road.
Brian Florek, LS, was available for the application. Staff reviewed the draft permit with the
Commission.
Motion: Motion made by W. Thomas, second by G. Renegar to approve a draft permit for
Application #C-21-03.
Vote: 6-0
C-21-04: 198 Shore Road: Stream Channel Stabilization — John Lombardi, Applicant &
Owner; J. Theroux, Agent;
J. Theroux and John Lombardi were available for the application. Staff read her review
comments dated May 26, 2021 with the Commission. She noted that she had walked the site with
two Commissioners. The Commissioners were shown a photo that was provided by the
applicant of the machine proposed to be used to place the rip rap.
J. Theroux responded briefly to the comments and noted he will submit written responses, make
plan revisions and prepare cross sections for the next meeting. He indicated there would be
approximately 60 cubic yards of rip-rap involved, placed from the south bank. Larger amounts of
rip-rap were originally considered and this is the alternative with reduced impacts. He will
document the tidal range in the channel. Also, erosion control blanket is proposed on the
disturbed slopes as well as seeding and mulching. No canopy trees are proposed to be removed.

D. Lersch asked if there are any migrating fish in the waterway. J. Theroux responded he did not
notice any but it could be feasible. He noted the rip-rap does not affect the depth of water in the
channel or restrict the channel.
The application was continued to the next meeting so the applicant can prepare responses to
staffs findings.
Motion: Motion made by W. Thomas, second by D. Lersch to modify the agenda and
move agenda items 5 and 6 to before entering Executive Session.
Vote: 7-0
5. VIOLATIONS
54 Rope Ferry Road — Unauthorized Clearing of Vegetation and Soil Grading Within and
Adjacent to Intermittent Watercourse at Rope Ferry Condominiums — Notice of Violation dated
February 5, 2021
Staff noted the letter sent to the representative of Condominium association regarding approval
of the restoration plan.
6. OTHER BUSINESS
305-317 Rope Ferry Road — Seaview Terrace — 2021 Monitoring Report
The Commission received the wetland and stormwater basin monitoring report required by the
inland wetland permit C-13-09.
994 Hartford Turnpike — Review of Plan Consistency with Permit C-20-03
Staff reviewed with the Commission a letter from the engineer looking to see if the proposed
modifications to the site plan are consistent with the permit #C-20-03 or if a new permit was
required. Staff reviewed a plan comparing the previously approved limits of clearing and
grading to the proposed new limits of work.
Motion: Motion made by W. Thomas, second by J. Wainscott to find that the proposed
modifications are consistent with C-20-03.
Vote: 7-0
W. Thomas recused himself and left the meeting.
4. EXECUTIVE SESSION
Motion: Motion made by D. Lersch, seconded by I. Plis to enter Executive Session to
discuss pending litigation at 7:01 pm.
Vote: 6-0
Motion: Motion made by I. Plis, seconded by J. Wainscott to exit Executive Session at
8:23 pm.

No actions were taken during the Executive Session. The only non Commission members
present were; Robert Avena, Esq., Town Attorney, Maureen FitzGerald, Environmental Planner,
Abby Piersall, Planning Director, Attorney Janet Brooks and Katrina Kotfer, Recording
Secretary.
7. ADJOURNMENT
