Please see attached. As it appears that Chairman Massad had researched this easement outside of the public hearing
process, I think it is important that the record include a copy of that easement.
Iam also attaching the minutes of the 1/27/20 meeting of the Commission where the adjacent three lot subdivision along
Old Norwich Road was approved. There is a discussion in the minutes about the unsafe sight line issue along Old
Norwich Road which led to the shared driveway being approved and located where it exists today.
The terms of that shared driveway easement make clear that the Roberts Village parcel is not a benefitted property to the
driveway easement. Under Section IX of the easement, any modifications (granting additional rights to the easement or
relocating it for example) must be approved by all lot owners. Mr. & Mrs. Arnold, the owners of the southernmost lot,
have made clear and in writing to you that they will not consent to any changes in the easement that might permit an
entrance for the Roberts Village project (an additional 24 homes) onto Old Norwich Road. As such, Chairman Massad’s
alternative access concept is not feasible nor is it advisable considering the substantial sight line issues previously
identified by the Commission in the subdivision matter.
Please add a copy of this email and the attachments to the record of the Roberts Village hearing.
