The Commission hereby authorizes the applicant to conduct
regulated activities in designated areas which fall under the
jurisdiction of the Inland Wetlands and Watercourses Act, as
amended, Section 22a-36 to 22a-45, inclusive, of the Connecticut
General Statutes.
This permit is a grant of approval from the Waterford
Conservation Commission to conduct the following requested
regulated activities:
Li. 
Construction of two single family homes adjacent to inland
wetlands.
All site activities shall be conducted in accordance with the
plans, specifications and documents of record. 
Any deviation
from the approved plans or construction sequence shall be cause
for enforcement action by the Conservation Commission.
The Conservation Commission has reviewed the plans of record and
the file documents and attaches the following conditions in order
to further protect the inland wetlands and groundwater on this
site and to minimize impacts associated with the proposal:

On-site grading and slope stabilization on lot #117A shall
take place immediately for the purpose of erosion control.
Such work shall be completed within thirty days.

Clearing limits shall be flagged, 
and erosion controls
installed, and checked by the Planning Department prior to
initiation of construction.
Bx 
Silt fence shall be placed at base of the disturbed slope
and around footing drain outlet.

Footing drains to be installed by hand.

The sediment fence shall be established as the non-
encroachment line, beyond which no clearing, building or
grading will be allowed without approval by the Waterford
Conservation Commission.

At all times during site work and until exposed areas are
stabilized, the applicant shall install and maintain erosion
and sediment control measures such as staked hay bales and
fabric filter fences, and such other measures as deemed
necessary by the Environmental Enforcement Officer. 
Such
protective measures shall be installed and maintained to the
satisfaction of the Environmental Officer.
The applicant shall, as soon as practicable, or at times
when directed by the Environmental Enforcement Officer,
perform such actions as necessary to stabilize exposed and
unstabilized areas of the site to the satisfaction of the
Environmental Enforcement Officer.
Erosion control and soil stabilization shall follow
guidelines as established in the Connecticut Department of
Environmental Protection Guidelines for Soil Erosion and
Sediment Control.
The Environmental Enforcement Officer must be notified at
least 48 hours prior to commencement of any permitted site
work.
Activities as authorized by this permit must be
substantially completed within one year of the date of
approval of this permit. 
If the work is not substantially
completed within this time the permit may be held to be
invalid by the Commission. 
The applicant may be required to
petition the Commission for reissuance of the permit. 
The
Commission may require the applicant to furnish additional
information at that time.
No materials may be deposited and no activities may be
conducted in any regulated areas except for those specified
in this permit in accordance with plans and documents
submitted as part of the application.
The Commission renders this Summary Ruling based on the following
considerations:
A. 
Strict adherence to the conditions imposed with this
permit will protect the quality of surface and ground-
waters on the subject property.
B. 
There are no disturbing or degrading activities
proposed in the wetlands.

Cc. 
Alternatives have been considered by the Waterford
Conservation Commission. 
The alternate design allows
for the maximum distance between the wetlands and site
disturbance.
This permit will be strictly enforced. 
The Commission may
suspend or revoke this permit, 
may direct the Environmental
Enforcement Officer to issue a cease and desist order or may
require the applicant to modify, extend, or revise the site work
or restore the area to its original condition if it finds that
the applicant has not completed with the conditions set forth in
this permit or if the applicant exceeds the scope of this permit
as set forth herein or if the intended use or actual use of the
general site is not as represented by the application or the plan
of record.
