Dear Mr. Brule,
Please add this email to the next Board of Selectmen
meeting's agenda.
SUMMARY OF MAIN POINTS OF OUR COMPLAINT
1) We have provided a petition to the town Government
signed by
47 residents of the Twin Lakes
Neighborhood complaining of zoning violations at 9
Waterview Drive, a residential home which has been
converted to an AirBnB commercial enierprise. lt is being
advertised as a party house and rented to very large
groups as a short term rental.
2) Large groups that use the outdoor pool to "party" often
drink alcohol openly, and swear, disrupting the
neighborhood peace and is a significant nuisance. The
noise carries throughout the community over the lake.
Often 7-11 cars congregate at 9 Waterview, speed up and
down the street and.are 
a danger to the young children
who live on the street. Covenants in our deed bar any
noxious use of the property that disrupts the community.
3) Our Lawyer, William McCoy, has advised that the
existing zoning laws of the Town of Waterford are
sufficient to prevent large groups from short term rental at
9 Waterview, yet nothing has been done to respond io the
community's complaints and petition.

DETAILS OF OUR COMPLAINT
This is not an ordinary AirBNB.It ls enormous with 7
bedrooms and a gym, indoor and outdoor pools. When
renters are outside or in the pool in warm weather, they
play loud music, yell, swear, and drink alcohol-disrupting
the quiet and peace of our neighborhood. It has prevented
us from entertaining on our deck or backyard when they
are outdoors using the grill, using the outdoor pool, or just
congregating in the backyard. One neighbor told me that
she had to bring her children inside because renters were
swearing loudly. The sound travels on the water so all the
neighbors around the lake hear it.
They charge $2500.00 per night, and advertise it as a
party house. Ten - twenty people stay there at a time. The
reviews refer to a great party house that they used for
many co-workers, clearly unrelated. We are all law
abiding, tax paying citizens of Waterford who bought our
homes imagining a peaceful life here. This is not only a
weekend rental. We have noticed people staying during
the week as well. This house has changed the character
of the neighborhood from a quiet, peaceful neighborhood
to a commercial enterprise that disrupts the nature of
the neighborhood, with cars speeding up and down the
street.
The owner, Shah Rahman lives in Queens, NY, and neve
lived here. He bought the house last spring and came for
couple weekends and then started renting it out on
AirBNB. It has been used to film a Lifetime Movie with

over 40 cars parked on our road, blocking mailboxes and
driveways. It was while asking one of the people from the
movie to move their car from blocking my driveway, that |
found out it was an AirBNB. One time a huge bus idled in
the street for hours in front of the AirBNB, making noise
and spewing gas fumes into our street.
We are aware that the zoning doesn’t allow a hotel in our
residential neighborhood. We also have a Declaration of
Restrictions, Covenants, and Easements from 1986, when
we moved into our house. It clearly states that:
"No noxious or offensive trade or activity shall be carried
on upon any lot nor shall anything be done thereon which
may be or become an annoyance or a nuisance to the
neighborhood.”
This house at 9 Waterview Drive violates this covenant, as
well as the zoning laws here in Waterford.
Forty-seven neighbors here in Twin Lakes signed a
petition in November, 2021, and submitted it to Town Hall
stating:
“The neighbors in the Twin Lakes subdivision express our
concern that single family homes in our area are skirting
the zoning laws by renting to large groups of unrelated
people for short term rentals. As tax paying citizens of
Waterford we feel our interests are being ignored. We
implore town officials to enforce the zoning laws in our
area so that 9 Waterview Drive, or any other homes are
prevented from carrying on rentals which violate the
Zoning laws."

Our attorney, William McCoy, wrote a letter to the owner in
November, 2021, which was ignored. The owner employs
a property manager who takes care of the rentals and
repairs.
We have also been informed that this will decrease our
property values and make it harder to sell our homes.
In summary, the people in this neighborhood are very
unhappy about this and implore you to enforce the law. It
is being operated as a hotel for large groups in our quiet
residential neighborhood, violating zoning regulations and
our Covenant.

This petition, signed by 43 homeowners, from 29 households in the Twin Lakes subdivision, is to
address the issue of zoning violations at 
9 Waterview Drive, which has been marketed and
rented as an airbnb to large unrelated groups, since being purchased by Shahriar Rahman of
Queens, New York. in April of 2021.
Our Concerns:
The Twin Lakes subdivision of Waterford is a quiet residential community that was
incorporated in 1976.The peace and quiet of this residential area has definitely been negatively
impacted by this business activity advertised at $2000/night, often catering to large, unrelated
groups. This summer it was rented to a team making a movie with some 30 cars lining both
sides of our street, blocking driveways and mailboxes. It was also rented several times to large
groups who partied, used profanities, yelled and played loud music in their outdoor pool.
Because of the unique arrangement of houses around two small lakes, the sound from their
property emanates over the water and throughout the neighborhood. People driving cars
recklessly to and from the property are also an issue as there are many small children who live
and play on the street.
The Twin Lakes subdivision has language in their deeds which states, “No noxious or
offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon
which may be or become an annoyance or a nuisance to the neighborhood.”
As concerned neighbors we have met several times regarding our complaints. Our
lawyer, William McCoy, tells us that rentals to large unrelated groups is a zoning violation under
current Waterford zoning regulations. When attorney McCoy sent letters regarding this issue to
Mr. Rahman, the owner of 
9 Waterview, he did not reply.
We have met with Ted Olynciw, our town representative, and contacted Baird Welch-
Collins to inform them of our concerns. We want the town to protect the peace and quiet of
our neighborhood and enforce the zoning laws to prevent large unrelated groups from using
9 Waterview Drive for short term rentals. As tax paying citizens and voters we ask that town
officials act quickly as this issue is particularly important to us. 
| am sure once the summer
begins large groups will again gather at 9 Waterview Dr disturbing the residential nature and
peace of our community.

1am writing to you because we have issues with your use of the property at 9 Waterview
Drive, both in terms of zoning issues and the violation of restrictive covenants for the
subdivision in which you reside. More specifically, it appears you are operating 9 Waterview
Drive as a short-term rental to people who do not qualify as a single-family for purposes of
zoning. In other words, your property is located in a single-family zone and as such, the use in
the single-family zone has to be for residency of a single family.
There have been a number of events at your property involving large groups of people on
short-term rental, which do not qualify as single-family uses. In addition to the zoning issues, the
level of noise and obnoxious behavior which has been conducted at the property is in violation of
the restrictive covenants for the subdivision of Oakdale, Inc.
The covenants I refer to can be found at Volume 244, Page 437 at the Waterford Land
Records and specifically, within the first page of those covenants, there is a prohibition against
noxious and offensive trade or activity which may become an annoyance or nuisance to the
neighborhood.

Asif (and Amanda!) were so helpful and communicative during our stay! The house was perfect for our
group of 12. It was gorgeous and very clean. We were even left cute little s’mores kits! The indoor pool,
hot tub and sauna were incredible-definitely our favorite part! There are multiple grocery stores very
close by as well which made cooking in the beautiful kitchen easy. | highly recommend staying here!

Asif was an outstanding host and his place was just amazing. Its like a resort except private. Clean and
neat as you expect. We really enjoyed the salt water indoor swimming pool and basketball court. Can’t

This place was absolutely fantastic

It was so clean when we first arrived. Lots of natural light and open space. And though it is a huge house,
the setting felt very cozy. Favorite part is definitely the indoor heated pool, hottub and sauna. The boys
loved the indoor basketball court. The property is situated in a private area that felt isolated from the
other houses in the neighborhood. We enjoyed the sound of water and crickets at night by the campfire.
And for louder activities, we shut all the doors and windows for little to no noise transference outside.
The house is well stocked. Plenty of extra towels/linens in every room, bluetooth speaker systems,

games, pool floaties, cooking supplies, spices, even Tylenol for the morning... And should you need
something else, there is a plethora of retail stores less than 7 minutes from the house.

This is a perfect getaway for the jaded city dweller, whether you want to play video games downstairs or

Dear Ted,
Thank you for speaking with me today regarding the Zoning fesues and disruption to the peace and quiet of the
neighborhood. | am happy to know
that yau are our fown representative here In Twin Lakes.
The owner of 9 Waterview Drive, Shahriar Rahman, Is renting tto large groups of unrelated individuals, Itis baing
marketed and rented on Air BNB
with the use of a pool where loud parties are being hosted often with music that echoes throughout the properties all
along the lake. On one weekend a group
of perhaps 30 cars descended and shot a movie there with cars blocking many driveways and causing a disruption to
the normal residential character of the street.
Nalghbors with small children have put up signs warning cars from speeding and this has been witnessed by several
people. On another occasion a luxury bus parked on the street,
shutting guests. | am sure this was not intended use when the subdivision was incarporated originally. (see the
covenant below}
| have also attached a file with the letter our Attomey William MoCoy sent to the owner, Shahriar Rahman fast month. He
has not replied.
Although | am named as the complainant, | have the support of at least 9 of the 11 farnilies around the lake, as on Sept
28th | personally (along with neighbors Eugene Chin and Hong: Wang) spoke with
these 9 neighbors and they are all very concerned and voiced interest in going forward. In a subsequent meeting at my

home with 10 neighbors on October 3rd, wa were in agreement that we should
involve the Town Zoning Board to enforce the zoning restrictions and.preserve the rights of the propetty owners here. -

Hello Artie,
I met with Mark Wujtewicz, Planner, and Jill Pisechko , Zoning Compliance Officer today and
this is what
information I got from them.
There are no Town Regulations regarding AirBNB
They recognize that this is starting to be a problem within our Town as it is already in other
Towns.
This matter is something they know they have to remedy with an ordinance or an addition to
their Zoning Regulations. but as of now nothing is in the planning state.
Meanwhile several possible ideas were discussed:
1, Asking Public Works to install NO PARKING SIGNS on both sides of the street. OR
2. Asking Public Works to install RESIDENT PARKING ONLY SIGNS on both
sides of the street.

3. Definitely report any problems to the POLICE DEPT. as often as they happen
including noise, blocking driveways, blocking mail delivery, trespassing on property
not theirs. This is very important since by doing this there will be a police log for every
incident.
Meanwhile I will draft a letter to Abby Piersall, Planning Director and a copy to the First
Selectman regarding this situation and copy will be sent to you.
That is all I can do for the time being.

Dear Abby,
We have a problem!
| had a meeting with Mark Wujtewicz and Jill Pisechko this week regarding
AirBNBs at 11 Waterview Drive or anywhere in our Town.
The owner is not living there and is leasing out this property as an Air BNB.
See attached flyer, which appears in the internet, which offers space for 16 overnight
guests.
In past months this property has been rented out and has caused much disturbance
within the neighborhood including cars blocking driveways, cars blocking mail service,
guests walking onto other neighbor's properties and loud noises.
Also attached is a copy of a letter from Attorney McCoy to the owner dated 9/16/21,
requesting a phone call to discuss this matter.
During the meeting with Mark & Jill several temporary options were discussed , but not
decided, including:
1. Asking Public Works to put up NO PARKING SIGNS on both sides of the street, or
2. Asking Public Works to put up PARKING FOR RESIDENTS ONLY signs
3. Notify the Police Dept. when ever the level of noise or obnoxious behavior is
observed.
Items 1 or 2 can only be ordered by the First Selectmen or some other authority but
not
the residents.
| realize that there are currently no ordinances or regulations or even any plans to
control the activity at the AirBNBs.
This is a very serious situation and | hope your office will do something to protect the
private enjoyment of our residents.

| have it on my list of issues to research and then bring a status report and options to the
Commission. Realistically that work will likely begin in late January /early February. | am not
sure what direction the Commission may take on the matter. I'm truly not trying to sound
noncommittal on an outcome- | think there may be a variety of opinions on the topic and 
| am
truly not sure where the Commission will land on this. Happy to discuss in person or on the

Dear Mr. Moderator,
We have a very serious situation regarding an AirBNB located at 9 Waterview Drive.
There are many ads on the internet that are listed as AirBNBs in Waterford. In itself
it does not seem to be a problem as far | know.
However, this property at 9 Waterview is advertised as having 9 bedrooms for 16
guests
at a rate of $2,000 per day. It is a very large complex with an indoor swimming pool
and
gym.
| have attached several email between the Director of Planning and myself including a
email from the next door neighbor Arthur Dean dated 10/6/21.
According to the last email | received from Abby dated 10/14/21 it looks like this matter
may not go before the P & Z Commission until Jan./Feb. of next year and is not sure
what
direction the Commission will take.
| as that you place this in the appropriate committee for action. Meanwhile, if you any
other
thoughts on how | can help these neighbors directly affected in this messy situation |
would
greatly appreciate your advice.

and overcrowding. | do not know if other Waterford homeowners have experiences any of these
issues but we have on Waterview Drive which has affected the peaceful enjoyment of my property
along with others that have signed the attached petition. included in this email Is a lst of

Having watched this group in action, would suggest this is the most effective way to get the message
across and get discussion on a meeting agenda:
Send the email TO the Police Commission Chair
CC the other members and the Chief
It goes without saying, but I'll say it anyway, because, well, can't help myself...
the greeting in the email body should be Dear Chairman Gelinas
there should be as many specific examples as possible (Greyhound tour bus on narrow cul de sac
where school buses dare not go, loud music/patty noises that go from X hour to X hour, and
definitely that horrific story about party-goet's traipsing through yards and standing on that poor
woman's deck to take pictures)
Include a line asking for followup....e.g., My neighbors and I would like the opportunity to discuss
these public safety issues with the Commission at yout next meeting. (it's the "ask" that forces a
response better than "thank you for bringing this to our attention")

Police Commission's next regular meeting is March 14 at 5pm.....vhich means emails should be sent

‘At 9 Waterview Drive there is an “airbnb" or "short term rental" (see attached), which
-$tated operating in August 2021, which is causing havoc in the entire neighborhood
including those on Twin Lakes Drive. Unlike other smaller aironbs his property is
advertised at $2000 per day and has accommodations for 16 guests. These are some
of the problems we are experiencing:
Grayhound tour buses dropping off guests on this narrow cul-de-sac street
Camera crews with trucks of equipment clogging the street
Cars fill up both sides of the street not allowing mail delivery or garbage pick-up.

A guest walking on the back deck of a neighbor's home and taking photos.

This is what we have done 80 far.
1.Brought to the attention of the Director of Planning, Abby Plersall, back in September
and she will be putting this on the P & Z agenda this Feb. or March.
2. Met with the Town Planner, Mark Wujtewicz and Zoning Compliance Officer, Jill
Pisechko and was told that there are presently no regulations concerning short term
rentals,
Their temporary recommendations until a new zoning regulation is adopted are:
A. Ask Public Works to put up PARKING FOR RESIDENTS INLY signs on both
sides of the street. This requires a recommendation by the Police Dept.
B. Notify the police whenever there are disruptive instances.
3.The Moderator of the RTM has placed this item into the Public Works, Planning &
Development Stand
