Mr. Dembek,
The purpose of the road acceptance requests for Kathryn Court and Seaview Terrace is to
enable to the Town to provide residents on these two streets with public services, including
trash removal and snow plowing. Residents have anticipated acceptance and the ensuing
services for several years, however progress on completion of public improvements within the
tight of way has only recently become sufficient to recommend that the roads be accepted into
Town road system. The Town departments have been coordinating with the developers to
complete the improvements within the right of way to allow the Public Works Department to
recommend acceptance of the roads. Acceptance would allow Public Works to the remove
snow, offer curbside collect of waste, and to maintain the pavement surfaces. Both of these
roads are at a point where | can recommend acceptance of the roads.
| have inspected both roads.- There are minor items that need to be completed before the Town
releases the bonds that we are holding, but these should not hold up the acceptance of the
roads,
Representative Ted Olynciw has sent these observations to the Department. My comments
follow each observation in italics.
SEAWIEW TERRACE
1. There are many trees that have not been planted around the entire perimeter of the street. |
believe trees are required every 75' or 100' by the regulations? Answer: The Plans (LSA 1.1
Planting) calls out the location and number of trees that are required to be planted by the
Developer. It is getting late in the season to secure the trees and to plant them.
2. There is no stop bar painted at the intersection of this street and Rope Ferry Road. This isa
requirement. Answer: That is correct. The Contractor just placed the final course of pavement.
Time is required to let the pavement “cure” before application of paint. The Developer will have
this painted in the upcoming weeks.

3. There is still filter fabric below the metal grates at several of the catch basins. This will cause
a major problems during the winter months if not removed. Answer: Contractor will have this
removed by Close of Business Friday (10/21/2021)
4. There is large unpaved circle at the end of the cul-de-sac. What improvements are shown
on the approved subdivision drawings? Present condition is some grass and an un-
vegetated area. Answer: The plans call for a depressed grassed area, the center trip of gravel
to allow the water fo percolate. The plans called for tree. The Town staff requested that the
tree be eliminated to protect the drainage system from future root damage.
KATHRYN COURT
1. The embankment on the right side of the entrance to the subdivision is very unstable. The
embankment is very steep and lacking in vegetation. Without proper vegetation, during
major rain storms, there could be considerable washouts in to the roadway. Once we accept the
road, without correcting this situation, it then become our problem. Answer: This slope has
remained stable after each one of the rain storms we have experienced. It still needs to be
vegetated and the developer is working on this.
2, There is a lack of trees as required by the regulations on the left side of the cul-de-sac.
Answer. That is correct. The Town is holding sufficient funds to plant the trees in spring if there
are still missing.
| guess my questions are:
1, Will the developer correct these items prior to the RTM Meeting. Answer: Both developers
are working to complete all the items remaining. /f any items do remain, the Town has bonds
that more than cover the cost to have the items completed.
2. If not will they be required to post a cash bond and in what amount. Answer. There are
bonds that the Town holds. The amount exceeds the Department of Public Works estimates to
complete any minor remaining issues or maintenance work that occurs during the one-year
period in which the bond is held post-acceptance.
