PHONE: 860-442-0553 www.waterfordct.org FIFTEEN ROPE FERRY ROAD WATERFORD, CT 06385-2886 PLANNING & DEVELOPMENT DEPARTMENT Date: July 24, 2022 To: Waterford Conservation Commission ce: Dan Matheson, Public Works From: Maureen FitzGerald, Environmental Planner Re: Conservation Commission Application #C-22-06 Gardiners Wood Road Drainage Improvements Application Review Comments Project Description: The proposed activity involves reclamation and repaving of Gardiners Wood Road, addition of drainage pipes to reduce incidence of roadway flooding and installation of guardrail in selected areas, An approximate 400 ft. section of the road is bordered by wetlands on each side. Proposed grading for road sideslopes will encroach 2-3 feet into the wetland for a length of 230 feet on the eastern side of the road and along 50 feet on the western side of the road. Total direct wetland disturbance is 925 square feet, Regulated activities include: fill of 925 sq. ft. of inland wetlands and fill and grading adjacent to inland wetlands and watercourses. Wetland Resources: The project area is located in the Beebee Brook watershed, a small drainage area that discharges to Jordan Cove through a culvert under Jordan Cove Road (see attached drainage area map). The wetlands bordering Gardiners Wood Road are primarily herbaceous emergent and scrub/shrub type communities seasonally flooded. Drainage ditches to promote water flow have been excavated at the edge of a portion of this wetland boundary on the west side of the road. Wetland functions include flood control, streambank stabilization, groundwater discharge, and nutrient retention and sediment trapping. Application Review Comments: 1.The site plan indicates the perimeter of the roadway re-surfacing work will be protected with sediment control wattles at the proposed toe of slope. This control measure should be installed prior to the start of road reclaiming work, 2. The areas of wetland impacted by the sideslope material are primarily phragmites on the west side of the road and a shrub/scrub swale on the east side of the road at the edge of the existing roadbed slope. The capacity of this wetland area to capture and convey water will be reduced by the encroachment of fill. However, the remaining swale area appeats sufficient to capture and direct sheetflow from the contributing upslope wetlands to the existing cross-culvert and proposed underdrain pipes. The addition of the 4 underdrain pipes in the lower area of the roadway are proposed to alleviate ponding of run-off from the east side of the road and transmit surface water to the west side where the roadside swales are not impacted. No alteration of flow patterns are anticipated. PHONE: 860-442-0553 www.waterfordct.org FIFTEEN ROPE FERRY ROAD WATERFORD, CT 06385-2886 Date: July 18, 2022 To: Joao Ferreira, Owner East Lyme Tree Services, LLC 67 Upper Pattagansett Road East Lyme, CT 06333 Re: Violation Notice — Unauthorized fill, grading & deposition 1122,/124 Hartford Turnpike Conservation Commission Review of Required Restoration Plan Mr. Ferreira, The Waterford Conservation Commission, at their July 14, 2022 meeting, received and reviewed a restoration plan for the areas of unauthorized clearing and deposition of wood chips within and adjacent to inland wetlands conducted at your property on 1122, 1124 Hartford Turnpike, Waterford, CT. The restoration plan was submitted by CLA Engineers, Inc. on July 13, 2022. The Conservation Commission recommends the following modifications to be included in the restoration plan. 1. Include plantings of tree and native shrubs in the restoration of the impacted areas on the northern and westerly side of the property after removal of the wood chip fill. 2. Mark the 50 ft. wetland buffer limit with large boulders or other substantive boundary markings to identify the limit on the site. The 50 ft. buffer area will be identified as a wetland non- encroachment area and markers are to be installed on the site identifying this area. No clearing, fill, grading or other alteration of this 50 ft. buffer area is authorized. 3. Identify the proposed time frame for completion of the fill removal and planting of the restoration areas on the site plan. The revised restoration plan shall be submitted to the Conservation Commission for review and approval within 30 days of receipt of this letter. Failure to comply with the terms of this letter may result in further enforcement action by the Conservation Commission, including but not limited to the issuance of a cease and desist order or transfer of the matter to the Town Attorney for legal action.- Please direct questions on this matter to the Planning & Development Office, attention Maureen FitzGerald, Environmental Planner (860 444 5813). The Commission required the following corrective actions be completed within 30 days of receipt of this letter to address the unauthorized activity in the wetland non-encroachment area: 1. Stop the cutting of vegetation and mowing in the wetland non-encroachment area east of your property and allow the undergrowth to return to its natural state. 2. Install a second 4x4 post off the northeastern corner of your rear property line to serve as a visual reminder of the extent of authorized mowing and maintenance for the pedestrian pathway approved under the subdivision. Please notify this office upon installation of this post and a non- encroachment area boundary marker will be affixed to it. A copy of the subdivision plan indicating your property limits and the approved wetland non- encroachment boundary is attached for your reference.
