I, CALL TO ORDER AND APPOINTMENT OF ALTERNATES
The meeting was called to order at 6:31 p.m. I. Plis was seated for the vacant seat.
2s APPROVAL OF THE March 9, 2023 MEETING MINUTES
Motion: Motion made by M. Keatley, second by W. Thomas to approve the March 9, 2023
meeting minutes.
Vote: 5-0-1 (G. Renegar abstained)
G. Renegar recused herself for the deliberation of C-22-14, 109R & 131 Clark Lane
3. APPLICATION REVIEW
C-22-14, 109R & 131 Clark Lane, 47 Unit Residential Development, Leo J. & Mary P.T.
Archambault, Trustees, Owner: Kingstown Properties, LLC, Applicant; David Held, P.E., L.S.,
Provost & Rovero, Inc., Agent-Review draft permit
Chairman R. Muckle asked commission members for any comments regarding the draft permit.
W. Thomas and I. Plis commented the permit was well written.
Motion: Motion made by W. Thomas, second by I. Plis to approve the draft permit as written.
Vote: 5-0-0
G. Renegar returned to the Commission meeting.
C-22-15, 130R Great Neck Road, New construction single family home and outbuilding, Dan Russ,
Owner; David Balfour, Applicant/Agent — Review draft permit
Motion: Motion made by W. Thomas, second by T. Maidelis to approve the draft permit
as written.
Vote: 5-0-1 (G. Renegar abstained)
4, NEW APPLICATIONS
C-22-17, 109R Old Colchester Road, Pond Construction, Joseph Assard, Owner/Applicant
The applicant was not present. Staff gave an overview of the application requesting authorization to
construct an earthen berm across an intermittent stream to create a pond. No excavation is proposed to
create the pond. W. Thomas asked if the dam will be regulated by the State. Staff will review. W.
Thomas commented he does not think a third party engineer review is necessary for this application,
however he requested better detailed plans be provided for the dam construction and materials

stabilization to prevent failure of the dam and sedimentation of the stream. The application was accepted.
C-22-18, 93 Shore Road, Modification of Permit C-14-9 NE Line, Jose Espinosa Owner/Applicant
Staff informed the commission that this application was received within the statutory time frame for
receipt at this scheduled meeting but after the agenda was posted. Staff reviewed the application which is
for modification of a wetland non-encroachment boundary of a prior permit. The owner wishes to have
more room around the southeast corner of the house to access the rear yard. Staff advised commission
members it would be beneficial for at least one or two commission members to review the site with her.
The application was accepted.
5. VIOLATIONS
407 Boston Post Road: Unauthorized Fill Within and Adjacent to Inland Wetlands & Watercourses
Corrective actions are due to be complete May 30, 2023.
47 Great Neck Road: Unauthorized Activity Within Inland Wetlands & Watercourses
Staff is working with the owner’s agent on a site plan for an outdoor landscaping materials sales area and
restoration of the cleared wetland and will have an update for the Commission at next scheduled meeting.
577 Vauxhall Street Extension: Unauthorized Activity Within Inland Wetlands & Watercourses
Staff has met with the property owner. Unauthorized fill activity extends along the edge of the lake onto
to State property as well as City of New London property. The Owner has 45 days to prepare and submit
a plan to the Commission showing the extent of activity and proposed restoration of affected wetlands.
