SECTION 1 - DEFINITIONS 
For the purpose of these regulations, certain terms or words shall be defined as below.  Words in the present 
tense include the future, the singular number includes the plural, and vice versa.  The word “person” includes a 
partner-ship, corporation, or other entity.  The word “lot” includes the word “plot”.  The word “building” 
includes the word “structure”. 
ACCESSORY BUILDING 
A detached subordinate building, the use of which is incidental to and customary in connection with the main 
building or use, and which is located on the same lot with such main building or use.  An accessory building 
shall be one, which is not attached to the main building by any covered porch, breezeway, or other roofed 
structure. 
ACCESSORY DWELLING UNIT (Effective 5/24/23) 
An Accessory Dwelling Unit means a separate dwelling unit that (A) is located on the same lot as a principal 
dwelling unit of greater square footage, (B) has cooking facilities, and (C) complies with or is otherwise 
exempt from any applicable building code, fire code and health and safety regulations.  
ACCESSORY OUTDOOR DINING (Effective 5/31/22) 
The outdoor service of food or beverage on the same premises, and as a subordinate use in association with a 
permitted and operating restaurant, café, seller or manufacturer of alcoholic beverages. 
ACCESSORY USE 
A subordinate use which is clearly incidental to and customary in connection with the main building or use and 
which is located on the same lot with such main building or use. 
ACRE 
For the purposes of these regulations, an acre shall be forty thousand (40,000) square feet of area. 
 ADAPTIVE REUSE DEVELOPMENT (Effective 9/1/14) 
A mixed use development or residential development use that converts sites with Underutilized Buildings, 
Brownfields or former Brownfield sites into modern and functional facilities that, by their nature of design 
and redevelopment, will enhance and protect surrounding properties values and reinforce the surrounding 
neighborhood.  
 ADAPTIVE REUSE ELIGIBILITY CRITERIA (Effective 9/1/14) 
Physical infrastructure, architectural, landscape (natural or manmade) characteristics used by the Commission 
to determine a property’s appropriateness to support Adaptive Reuse Development.  
AGGREGATE (Effective: 4/5/18) 
A material formed from a loosely compacted mass of mineral fragments or particles 
AGRI-TOURISM (Effective: 1/29/18) 
Business of establishing farms as travel destinations for educational, recreational and commercial purposes that 
support a farm where farming activities take place and are directly related to the farm or farming activities. 
ALCOHOLIC BEVERAGES, MANUFACTURER OF (Effective: 6/25/20) 
An establishment which produces alcoholic beverages as defined in the Connecticut Liquor Control Act and 
may include the wholesale, retail, distribution, or consumption on premises of alcoholic beverages produced on 
site. 
ALCOHOLIC BEVERAGES, SELLER OF (Effective: 6/25/20) 
An establishment which sells alcoholic beverages as defined in the Connecticut Liquor Control Act for consumption off the 
premises. 
 
ALCOHOLIC BEVERAGES, SERVER OF (Effective: 6/25/20) 
An establishment, which serves alcoholic beverages as defined in the Connecticut Liquor Control Act for consumption on 
the premises, as licensed by the State. 
 
 

 
 
AQUIFER  (Effective: 4/5/18) 
A porous water-bearing formation of permeable rock, sand or gravel capable of yielding economically 
significant quantities of groundwater. 
ASSEMBLY 
The combining of component parts having form and substance by physically mating or joining the component 
parts. 
ASSISTED LIVING (Amended 8/19/08) 
A full care and/or special care building for person(s) where at least one resident is over the age of 55 who need 
assistance with one or more functions of daily living.  Private residential areas for up to two persons, 
containing a bath, sleeping accommodations, and a limited food preparation area, are combined with common 
dining and activity spaces to create a communal setting for the occupants.  Access is provided within the 
building to social, recreational, personal and essential care services for the occupants to continue a level of 
independent living.  An assisted living residence shall only be occupied by an individual and their spouse 
and/or a person providing care to such individual.  
BEST MANAGEMENT PRACTICE (BMP) (Effective: 4/5/18)  
A BMP is a technique, process, activity or structure used to reduce the pollutant content of a storm water 
discharge.  BMPs include simple non structural methods such as good housekeeping and preventative 
maintenance.  BMPs may also include structural modification, such as the installation of bioretention 
measures.  BMPs are most effective when used in combination with each other, and customized to meet the 
specific needs (drainage, materials, activities, etc.) of a given operation. 
BILLBOARD 
A panel or structure designed or used for outdoor advertising of products and services unconnected with the 
premises on which it is located and mounted on a building or on a separate frame located near a highway, 
railroad, or waterway. 
BIORETENTION (Effective: 4/5/18)  
A practice to manage and treat stormwater runoff by using a specially designed planting soil bed and planting 
materials to filter runoff stored in a shallow depression.  Bioretention areas consist of a mix of elements each 
designed to perform different functions in the removal of pollutants and attenuation of stormwater runoff. 
BROWNFIELD (Effective 9/1/14) 
As defined by Connecticut General Statutes §32-9kk(a)(1) as it may be amended from time to time as “any 
abandoned or underutilized site where redevelopment, reuse or expansion has not occurred due to the presence 
or potential presence of pollution in the buildings, soil or groundwater that requires investigation or remediation 
before or in conjunction with the restoration, redevelopment, reuse and expansion of the property.”  
BROWNFIELD REDEVELOPMENT (Effective: 9/1/14) 
Brownfield Redevelopment: The redevelopment of a site which is classified as a Brownfield and may or may 
not include the reuse of existing buildings.  
BUFFER STRIP 
A parcel of land unoccupied by buildings, structures, or pavements and maintained as a grass area and/or 
planted with trees or shrubs. 
BUILDING 
Any structure having a roof and intended for the shelter, housing, or enclosure of persons, animals, or 
materials.  Any other structure more than 6 feet high shall be considered as a building, including a solid fence 
or wall, but excluding an electric transmission line or an electric light, telephone or telegraph pole, radio or TV 
antenna, highway or railroad bridge, or flagpole. 
BUILDING, MAIN 
A building in which the principal use of the lot on which it is located is conducted, or is intended to be 
conducted. 
BUILDING AREA 
The ground area enclosed by the walls of a building together with the area of all covered porches and other 
roofed portions. 
BUILDING COVERAGE 

 
The percentage, which the aggregate area of all buildings on the lot bears to the area of the lot. 
 
BUILDING HEIGHT (Effective: 9/26/16) 
The vertical distance from the average finished grade within 10 feet of the walls of the building to the highest 
point of flat or mansard roofs including the top of a parapet or to the mean level between the eaves and ridge 
for gable, hip, or gambrel roofs.  
 Buildings located in an F.E.M.A Designated Flood Zone AE and VE or both, the height shall be measured 
from the Base Flood Elevation (BFE) plus Two (2) feet as shown on the latest version FIRM (Flood Insurance 
Rate Map). 
BUILDING LINE 
A line parallel to the abutting street at a distance equal to or greater than the minimum front yard setback at a 
point where the required minimum lot width is achieved. 
BUSINESS OFFICE 
Office of person or persons principally used as an office of a business or company which supplies a service or 
product to be delivered to or used for a site other than the business office.  Types of uses include real estate, 
insurance, travel agents, and contractors offices.  The following are not business offices:  retail sales, 
professional offices, medical testing laboratories, and personal service establishments.  
CAFÉ (Effective: 5/1/17) 
 A small restaurant selling light meals and drinks that may include an outdoor seating area. 
CANNABIS ESTABLISHMENT (Effective: 12/14/22) 
A Producer, Dispensary Facility, Cultivator, Micro-cultivator, Retailer, Hybrid retailer, Food and Beverage 
Manufacturer, Product Manufacturer, Product Packager, Delivery Service, or Transporter as defined in CGS 
§21a-420(4) as may be amended. 
CATCH BASIN (Effective: 4/5/18) 
A structure placed at or below grade to conduct water from a street or other paved surface to the storm sewer. 
CATCH BASIN INSERTS (Effective: 4/5/18) 
A structure, such as a tray, basket, or bag that typically contains a pollutant removal medium (i.e., filter media) 
and a method for suspending the structure in the catch basin.  They are placed directly inside of the existing 
catch basins where stormwater flows into the catch basin and is treated as it passes through the structure. 
CERTIFICATION 
A signed, written approval by the Commission that a soil erosion and sediment control plan complies with the 
applicable requirements of these regulations.  
CISTERNS (Effective: 4/5/18) 
 Containers that store larger quantities of rooftop stormwater runoff and may be located above or below 
ground.  Cisterns can also be used on residential, commercial and industrial sites.  See Rain Barrel. 
CLAY (Effective: 4/5/18) 
Soil mineral particle less than 0.002mm diameter 
CLUB 
An association of persons, which is the owner or occupant of an establishment, operated solely for a 
recreational, social, fraternal, religious, or political purpose and not operated for profit or gain. 
COMMISSION 
The Waterford Planning and Zoning Commission.

An institution which provides skilled nursing care under medical supervision and direction to carry out non-
surgical procedures for chronic diseases, convalescent stages, acute diseases or injuries and continuing care.
