ROLL CALL Present: Thomas Dembek, Kathy Mullen Kohl, Tim Condon, Nick Gauthier Absent: Shawn Monahan Also Attending: Town Clerk David L.Campo, Town Attorney Robert Avena, RTM Member susan Driscoll, Interim Director of Fire Services Stephen Dubicki PUBLIC COMMENT on proposed addition to the Waterford Code of Ordinance (Draft Attached) Chairman Condon opened the public hearing at 6:30 P.M. Former Jordan Fire Department Chief Tim Sullivan noted that the word “death” should be added to the title. MOTION by Gauthier, seconded by Kohl, to close the public hearing at 6:40 P.M. VOTING IN FAVOR: Unanimous The September 11, 2024 Special Meeting of the Public Protection & Safety Standing Committee of the RTM was called to order by Chairperson Tim Condon at 6:40 P.M. ROLL CALL Present: Thomas Dembek, Kathy Mullen Kohl, Tim Condon, Nick Gauthier Absent: Shawn Monahan Also Attending: Town Clerk David L.Campo, Town Attorney Robert Avena, Interim Director of Fire Services Stephen Dubicki AGENDA ITEM 3: Minutes MOTION by Gauthier, seconded by Dembek, to approve the minutes from the August 29, 2024 meeting. VOTING IN FAVOR: Unanimous AGENDA ITEM 4A: No discussion AGENDA ITEM 4B: No discussion AGENDA ITEM 4C: Review of ordinance 2.36 and HB-5279 for legal review and recommendation of assigned duties to the Director of Fire Services, RTC 06/03/24. MOTION by Gauthier, seconded by Mullen Kohl, to add the word “death” to the title VOTING IN FAVOR: Unanimous MOTION by Gauthier, seconded by Mullen Kohl, to approve the final draft of the proposed new ordinance, Section 2.116.110. (See attachment) VOTING IN FAVOR: Unanimous MOTION by Gauthier, seconded by Mullen Kohl, to report the “review of HB5279” issue out with a recommendation that the RTM approve the addition of new ordinance Section 2.116.110 in order to comply with recent revisions to Connecticut General Statutes Sec. 7-313. VOTING IN FAVOR: Unanimous MOTION by Dembek, seconded by Gauthier, to adjourn at 6:49 P.M. VOTING IN FAVOR: Unanimous Respectfully submitted, Timothy Condon Chairperson Ordinance No. 2.116.110 LINE OF DUTY DEATH DETERMINATION COMMITTEE 1. Pursuant to Connecticut General Statutes § 7-313e, the Town of Waterford designates the following Committee to determine whether a firefighter or police officer died in the line of duty, as defined in § 7-313e: a. Director of Fire Services b. Police Chief c. Human Resources Director, or their designee. 2. In those circumstances where the determination, under § 7-313e, must be made, the Committee shall make the determination by majority vote. The Committee may request information needed to make the determination from the Department or an applicant. 3. In accordance with § 7-313e, the determination shall not be used as evidence for a workers’ compensation claim. Effective Date:
