The June 10, 2019, Special Meeting of the Public Health, Recreation & Environment Standing Committee
of the RTM was called to order by Chairperson Michael Rocchetti at 6:30 P.M.
PLEDGE OF ALLEGIANCE
ROLL CALL ;

PUBLIC COMMENT:
RTM Member Susan Driscoll noted the hard work of the committee and stated her appreciation.
AGENDA ITEM 5: Approval of Minutes.
MOTION by Welch-Coilins, seconded by Olynciw, to accept the minutes from the May 13, 2019 meeting
VOTING IN FAVOR: Unanimous
AGENDA ITEM 6 : Presentation from American Progressive Bag Alliance.
Chairman Rocchetti informed the committee that the presentation was cancelled by the alliance due to
the fact that The State of Connecticut had passed legislation that is expected to be signed into law by
the governor taxing single use plastic bags by retailers until June 30, 2021. The law will then ban single
use plastic bags meeting particular specifications on July 1, 2021.
Committee members discussed the new legislature and its impact on its charge of “single use plastic
bags” and how it may affect the committee’s recommendation.
MOTION by Goldstein, seconded by Welch-Collins, to recommend to the RTM that the item “single use
plastic hags (RTC 04-02-18)” be taken out of committee with no action due to the fact that The State of
Connecticut passed legislation addressing this issue immediately and ultimately banning “single use
plastic bags” July 1, 2021 on a statewide scope.
MOTION by Welch-Collins, seconded by Cairns, to adjourn at 7:40 P.M.

DATE: July 21, 2020.
TITLE: Proposed Changes to the Waterford Code of Ordinances Chapter 12,08 Concerning the
possession and drinking of alcoholic beverages in town parks and recreation areas.
This request is to consider the potential to allow the possession or drinking of alcoholic beverages at
recreational facilities during special events approved by the Board of Selectmen, Alcohol is currently
prohibited at Town facilities. This change would enable events such as concerts, fundraisers, or festivals
to include the sale and consumption of beer or wine, The change sould not enable possession of alcohol
at school properties or on beaches.
Changing this Ordinance is a key step in reducing restrictions on the range of events that can be held on
iown properties. The addition of carefully planned service of wine or beer can hefp broaden participation
in Waterford events and draw new attractions to Town. Enabling sanctioned alcohol consumption in
public places supports ongoing efforts increase the frequency and diversity of dynamic and vibrant events
in Waterford, Events like dinners at the historic Jordan Green, summer concerts at the Waterford Beach
Pack, or craft beer and wine tasting at the Farmers Market could be permitted if the Ordinance is changed,
As proposed, the change would only allow beer and wine to be available as sanctioned on a case-by-case
basis by the Board of Selectmen,
Section 12.08.040 currently reads:
The possession or drinking of aleoholic beverages in any town park and recreational area,
including Waterford Beach, is prohibited.
Proposed language for 12.08.040 is:
The possession or drinking of alcoholic beverages in any town park and/or recreational
area is prohibited, except as provided below: - :
A, Possession and drinking of beer and wine may be permitted at locations and times
as approved by the Board of Selectmen. In no case will the possession and drinking
of beer and wine be allowed on the sand or dunes of any beach. :

MOTION by Oriscall, seconded by Attanasio, a recommendation from the Board of Finance, tabled from
the February Meeting, for an appropriation in the amount of $26,000 from Line Item #205-31520 —
Undesignated Fund Balance based upon its consistency with the Capital Improvement Plan, to purchase
real estate located at 13 Parkway Drive and on recommendation of Town Attorney Rob Avena to
postpone until the June Meeting of the RTM.
VOTING IN FAVOR: Unanimous.
CALL ITEM 4 — Tennis Court Surface Repairs
PRESENTATION: Director of Recreation & Parks Brian Flaherty.
MOTION by Muckle, seconded by Welch-Collins, to approve a recommendation from the Board of
Finance for the appropriation of funds from the Undesignated Fund Balance Line Item #205-31520 and
the Capital and Non-Recurring fund to Line Item #20537-57796 — Tennis Court Surface Repairs -
$9,000.
VOTING IN FAVOR: Attanasio, Bono, Bracciale, Cairns, Dembek, Driscoll, Elci, Fioravanti, Furey-Wagner,

MOTION by Welch-Collins, seconded by Ritchie, to approve a recommendation from the Board of
Finance for an appropriation of Line Item #20537-57782 ~ Replacement of Causeway Bathroom WBP -
$126,300 to Line Item #20537-57781 Waterford Beach Pavilion Restroom - $92,687. Making the new
total for Line Item # 20537-57781 Waterford Beach Pavilion Restroom - $218,987.
MOTION to move the question by Steward-Gelinas, seconded by Muckle.
VOTING IN FAVOR: Unanimous. .

MOTION by Muckle, seconded by Bono, on recommendation of the First Selectman to designate the
above motion as an emergency appropriation and waive the fifteen-day waiting period in order to keep
people working during the COVID 19 crisis.

CALL ITEM 6 — Ordinance Amendment, Chapter 8.04 — Refuse Collection and Disposal
MOTION by.Wéich-Collins, seconded by Bono, to approve a recommendation from the Public Works,

Pianning & Development Standing committee of the RTM to amend the Waterford Code of Ordinances,
Chapter 8.04 — Refuse Collection and Disposal to accommodate a facility change. (See Attachment)

CALL ITEM 7 ~ Waterford Town Beach Fees
PRESENTATION: Director of Recreation and Parks Brian Flaherty.
MOTION by Welch-Collins, seconded by Olynciw, to approve a recommendation from the Director of the
Parks and Recreation Department, Brian Flaherty, to approve an increase to the Waterford Town Beach
parking fees as presented at the February meeting and to review the fees at the February 1, 2021
meeting of the RTM.
MOTION by Driscoll, seconded by Welch Collins, to amend the motion to read as follow: To direct the
Parks and Recreation Department to maintain the 2019 beach fee schedule through the 2020 season
and utilize departmental savings and/or revenues to provide the necessary funds to cover the applicable
sales tax, and to establish a special Ad-Hoc committee to review, evaluate, and recommend a fee pricing
schedule at the October 2020 RTM meeting.
MOTION by Bono, seconded by Goldstein, to send the item to a standing committee rather than create
an Ad-Hoc Committee.
MOTION by Bono, seconded by Goldstein, to withdraw.

follows: To direct the Parks and Recreation Department to maintain the 2019 beach fee schedule
through the 2020 season and utilize departmental savings and/or revenues to provide the necessary
funds to cover the applicable sales tax, and to refer the beach fees issue to the RTM's Public Health,
Recreation and Environment standing committee to review, evaluate, and recommend a fee pricing
schedule at the October 2020 RTM meeting.

A brief discussion led by Town Attorney Robert Avena to schedule a special meeting to discuss the
budget schedule as well as address Governor Lamont’s Executive Order 75, Section 6. It was agreed to
meet again at a special meeting on April 20, 2020 at 3:30 P.M.

RE: Proposed Beach Parking Fee Increase

As your aware, the Commission’s request to increase Town Beach parking fees was tabled at the RTM
meeting of February 3, 2020. The reason for the increase was due to the State of Connecticut legislature
repealing the sales-tax exclusion for municipal seasonal parking lots.
At our commission meeting held on February 25, 2020, the commission decided to keep the original
request (Minutes attached).

The Recréation and Parks Commission held their regular meeting on Tuesday, February 25, 2020 at the
Community Center. Chairman Santos presided.

STAFF REPORTS: The Director reported on the expenditures ($852,913 — 56%) and revenues at
$165,754 - +1.3% from 2019). He discussed the major emphasis on the Civic Triangle trail/areas and
improvements around the pond areas, The Board of Selectmen approved our revised Fiscal Year 20-21
budget for $1,519,608 (0% increase). The Board of Finance will hear our budget on March 4, 2020 @
7:00 p.m. A discussion was held on the Credit card/software update with a plan to move forward. We
have had a Mitchell College student intern, Hanna Corrigan, spending a few months with the
department. The RTM, at thelr February 3, 2020 meeting tabled our request to increase Waterford
Beach parking fees (originally brought forward when we were.advised the state is requiring sales tax to
be charged) in order for us to provide additional information for their April 6, 2020 meeting. Our
proposed current year 2021 CIP projects (Tennis Court Replacements, Vet's Field Lights and Vet's Garage
Addition plan) have been moved forward in the plan by the Board of Selectman. The Waterford Beach
Bathrooms (2) are still in the planning stages, as the plans for the pre-cast building cannot be used,
according to Ct. DEEP, as they would have to meet VE zone standards. The Board of Selectman
recommended $150,000 in CNR funds for the bathrooms/improvements. Tennis Court repairs need to
be completed this spring. The Leary Park Basketball court reconstruction and the Town Hall basketball
court repairs are planned for the spring of 2020. The Dog Park Fence replacement is near compietion.
MOTION #2: Made by C., Erricson, seconded by C. Hall to keep the same recommendation as approved
by the Commission, to request an increase in beach fees due to the sales tax as directed by the State of
Ct. A discussion was held. Motion carrled 7-0. .
MOTION #3: Made by C, Erricson, seconded by C. Gardiner to request an additional $9,000 to complete
the temporary repairs to the tennis courts. So voted 7-0,

At the RTM meeting of February 3, 2020, a request for additional information was requested. Attached
is a survey of regional beach fees in our area, as well as a breakdown of beach revenue for the 2019
season.
in order to keep the resident fees at the 2019 level, the fees would need to be decreased as follows:
Resident 1° Sticker: $18.81 + $1.19 tax= $20 Resident Additional Sticker or Senior Citizens: $9.40 + $.60
tax=$10,00
Daily Resident Pass: $1.88 + $.12 tax=$2.00 Dally Resident Weekend Pass: $4.70 + $.30 tax=$5,00
it was suggested by some RTM members that raising the beach fees for out of town residents could
supplement the loss of revenue, | would advise that the town attorney be consulted for his opinion
concerning this approach. Total beach sticker & dally revenue can be located on the attached revenue
breakdown.
